Pursuant to and in accordance with the provisions
of N.J.S.A. 40:12-1 et seq., there is hereby created a Board of Recreation
Commissioners, the members of which shall be appointed by the Mayor,
in accordance with the provisions of N.J.S.A. 40:12-1.
Said Board shall consist of seven members, who
shall be designated "Commissioners," and two alternate members.
The Commissioners first appointed shall hold
office for one, two, three, four and five years, respectively, as
fixed by the Mayor, and thereafter all appointments shall be for a
term of five years. Vacancies shall be filled for the unexpired term
only. The Commissioners shall serve until their successors are appointed
and shall qualify. The Commissioners shall receive no compensation
for their services.
The alternate members of the Board of Recreation
Commissioners shall be designated at the time of appointment as "Alternate
No. 1" and "Alternate No. 2." The length of the terms of the alternate
members shall be for five years, except that the terms of the Alternate
Commissioners first appointed shall be staggered by the appointment
of one of the alternates for an initial four-year term. Alternate
members shall be governed by the provision of N.J.S.A. 40:12-1.1.
The Board of Recreation Commissioners shall
receive an annual appropriation for the purposes of administration,
maintenance and construction necessary to the system, and they shall
be provided with suitable quarters for the conduct of their operations.
The Board of Recreation Commissioners shall
have such powers and shall receive such financial aid from the municipality
as shall be authorized by N.J.S.A. 40:12-1 to 40:12-15, inclusive.

The following shall govern meetings of the Commission:
A. The Commission shall hold regular meetings, at least one in each
month. Said meetings shall be subject to the requirements of the Open
Public Meetings Act (N.J.S.A. 10:4-6 et seq.). The Commission shall
keep minutes of its meetings which minutes shall be open to public
inspection, subject to and in accordance with the Open Public Meetings
Act. The Commission shall send a copy of the minutes to the Township
Committee.
B. At all such meetings there shall be a majority (four) of the full
authorized membership of the Commission (seven) to constitute a quorum.
C. The Commission shall at its first regular meeting appoint a Chair
and a Vice Chair, each of whom shall hold office for a period of one
year until a successor has been appointed, and each shall carry out
duties normally attributed to that office.
D. The Commission may from time to time by affirmative vote of not less
than 2/3 of the members present, appoint a committee or committees
for any specific purpose or purposes within the jurisdiction of the
Commission.
E. The Commission shall have authority to appoint members of the Township
at large as an advisory committee, and to meet with that advisory
committee from time to time as the Commission deems necessary.
F. All actions of the Commission shall be taken by motion, and all actions
requiring the expenditure of funds or execution of contracts shall
be memorialized by resolution. The Commission may within matters within
its jurisdiction enter into contracts or agreements with any person,
firm, partner or corporation, subject to such limitations as are imposed
by law, and shall not be contrary to established Township Committee
policy.

The Commission shall consult with the Township Committee regarding
insurance coverages which it deems necessary by reason of its undertakings
and shall include estimated insurance expenses within the Commission's
annual proposed budget to the Committee. The Commission shall make
appropriate arrangements with the Township insurance providers with
respect to insurable interests and events under the control and jurisdiction
of the Commission.

The Commission shall establish a Facility Use Policy, or adopt
the existing Facility Use Policy as successor to the Park Committee.
The Facility Use Policy is subject to review and approval by the Township
Committee. All approved facility use requests existing as of the date
of this ordinance shall be grandfathered and continue in effect pursuant
to the terms of the agreement.

The Commission shall operate recreational programs as successor
to the Recreation Committee.

In addition to its other powers, the Commission is also empowered
regarding the properties under its control and jurisdiction:
A. To charge and collect fees for admission to any building or to any
part or parts of any park or open space under its jurisdiction, providing
such fees are included in the Facility Use Policy;
B. To rent, in accordance with the Facility Use Policy, for any period
not in excess of 12 months at any one time the use of any buildings
or part of any building or any portion or portions of any park or
open space, and to fix and collect the rent and fees payable by the
person or persons renting or using the same, providing such rents
and fees are included in the Facility Use Policy;
C. To close to the free use of the public the whole or any part of any
park or open space or the whole or any part of any building or buildings
erected thereon, at such times or for such periods as may be deemed
advisable; to charge and collect fees for the admission of such parks,
grounds or buildings or parts thereof during such periods, provided
such charges and fees are included in the Facility Use Policy;
D. The Commission is empowered to make such regulations as are necessary
to enable it to properly exercise the powers conferred upon it by
this ordinance.
