A. 
All applicants for positions and employment in the classified service of the County of Atlantic shall be bona fide residents of the County at the time of the closing date following the announcement of examination by the Civil Service Commission; provided, however, that if the Commission, after ample advertisement, determines that an insufficient number of qualified residents exists for the available positions or employment in the County of Atlantic, it may open eligibility lists for positions and employment to qualified nonresidents.
B. 
Where the Civil Service Commission determines that there is an insufficient number of qualified residents and opens eligibility lists to qualified nonresidents, it shall classify all qualified applicants for such positions in the following manner:
(1) 
Residents of Atlantic County.
(2) 
Other residents of contiguous counties.
(3) 
Other residents of the state.
(4) 
All other qualified applicants.
C. 
The appointing authority shall first appoint all of those in the class in Subsection B(1) above and those in each succeeding class in the order above listed and shall appoint a person or persons in any such class to a position or positions of employment after all qualified applicants in the preceding class or classes have been appointed or have declined an offer of appointment.
D. 
The preference established by this section shall in no way diminish, reduce or effect the preferences granted pursuant to any other provisions of the law.
E. 
Any employee hired pursuant to this section may be required, as a condition of continued employment, to establish a bona fide residence in the County.
F. 
Exceptions.

(1) 
The exception to the preference order outlined in Subsection B(1) above will result when the available position is located in the Cape May County office of the Atlantic Cape May County Workforce Investment Board and is one of the following titles:

(2) 
When the above conditions are met, the Civil Service Commission shall classify all qualified applicants for such positions in the following manner:
(a) 
Residents of Cape May County.
(b) 
Residents of Atlantic County.
(c) 
Other residents of contiguous counties.
(d) 
Other residents of the state.
(e) 
All other qualified applicants.
For the purposes of this article, a bona fide resident shall be a person having a permanent domicile within the County of Atlantic and one which has not been adopted with the intention of again taking up or claiming a previous residence acquired outside of the boundaries of the County of Atlantic.
A. 
Where the County Executive determines that there are certain specific positions requiring special talents or skills which are necessary for the operation of the County and which are not likely to be found among the residents of the County, such positions shall be filled without reference to residency.
B. 
Any such determination shall be made pursuant to the following criteria:
(1) 
The position is deemed by the County Executive to be needed to perform services permitted by law;
(2) 
The duties and tasks of said position require the individual's possessing specialized talents or skills, including the completion of training leading to technical or professional degrees or other certification and/or demonstrated effective experience in performing those duties requiring such specialized talents or skills; or
(3) 
It can be shown by the records of the County administration, the New Jersey Department of Civil Service and/or the Division of Personnel that it was necessary to go beyond the boundaries of the County of Atlantic to recruit a sufficient number of qualified applicants for said position within the past 12 months.
C. 
The County Executive shall notify the Clerk to the Board of County Commissioners when the provisions of this section are invoked.
Nothing contained herein to the contrary, this chapter shall in no way affect or apply to persons already in the employ of the County of Atlantic at the time of the adoption of this chapter.
A certified copy of this article shall be forwarded by the Clerk to the Board of County Commissioners to all County agencies and County educational institutions to indicate the intent of the County.
A certified copy of this article shall be served on the Secretary to the Civil Service Commission by the Clerk to the Board of County Commissioners.
