[Adopted 9-19-1989 as Ord. No. 1989-11 (§ 2-20 of the 1984 Code)]
As used in this Article, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Bay Head, County of Ocean, State of New Jersey.
CHIEF FINANCIAL OFFICER
The person who is a certified Municipal Finance Officer appointed by the Borough under § 5 of P.L. 1988, c. 110[1] to carry out the responsibilities set forth under P.L. 1947, c. 151.[2]
GOVERNING BODY
The governing body of the Borough of Bay Head, County of Ocean, State of New Jersey.

The position of Chief Financial Officer is hereby established in the Borough of Bay Head and in accordance with the provisions of P.L. 1988, c. 110.[1]

The Chief Financial Officer shall be appointed by the Mayor and the appointment confirmed by the governing body in accordance with the statutes of New Jersey. The person appointed as Chief Financial Officer shall hold office until December 31 next following the appointment thereof. A vacancy in the position of Chief Financial Officer shall be filled in the same manner as above and for the unexpired term only.
The Chief Financial Officer shall be qualified, by training, education or experience, to perform the duties of the office in accordance with P.L. 1988, c. 110.[1]

The Chief Financial Officer shall have, perform and exercise all the following functions, powers and duties provided by general law and Borough ordinances:
A. 
Keep such books and accounts relating to funds entrusted, received or under the control of any department of the Borough, in accordance with the standards and requirements of the Division of Local Governmental Services in the Department of Community Affairs of the State of New Jersey, and, by the next ensuing bank day after their receipt, shall deposit all funds received by him in depositories authorized by the governing body by resolution.
B. 
Be the depository for and have custody of all investments and invested funds of the Borough or in the possession of the Borough in a fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Borough not required for current operations safely invested or deposited in interest-bearing accounts.
C. 
Be the depository for and have custody of all funds and notes of the Borough and also the receipt and delivery of Borough bonds and notes for transfer, registration or exchange.
D. 
Keep a full account of all cash receipts and disbursements of the Borough and, at least once each month or more often if the governing body requires, furnish the governing body with a statement of all moneys received and expended by him.
E. 
Make such additional reports to the governing body on the Borough's financial status as the governing body may request or as required by ordinance.
The Chief Financial Officer shall be paid as designated in the Salary Ordinance.[1] The salary shall commence on the date of appointment and confirmation as Chief Financial Officer.

There may be an assistant appointed by the governing body for the term of one year. It shall be the duty of the Assistant Financial Officer generally to aid and assist the Chief Financial Officer in the performance of the duties of his/her office in such manner as the Chief Financial Officer shall from time to time direct. The Assistant Financial Officer shall perform the duties of the Chief Financial Officer in the latter's absence or incapacity.
