A. All
full-time nonunion permanent employees, 35 or more hours weekly, shall
receive $25 per year for every year of service up to 10 years of service,
payable on the anniversary of the start of employment of the employees.

B. All
full-time nonunion permanent employees, 35 or more hours weekly, shall
be eligible for $35 per year for every year of service above 10 years
of service and less than 16 years of service, payable on the anniversary
date of the start of employment of the employee.

C. All
full-time nonunion permanent employees, 35 or more hours weekly, shall
be eligible for $50 per year for every year of service above 15 years
of service payable on the anniversary date of the start of employment
of employee.

D. The
longevity schedule shall not pertain to non-union employees hired
after October 3, 2006.
E. Police officers.

(1) Police officers shall be paid longevity, in addition
to annual base salary based upon continuous years of employment as
a regular officer in the Police Department as follows:

(2) Longevity payments shall be calculated or recalculated
immediately following the anniversary date of employment of each employee;
paid biweekly; and included as part of the employee's regular paycheck.

A. All full-time nonunion permanent employees, 35 or more hours weekly,
are permitted 15 sick leave days per year. The amount of such leave
not taken shall accumulate from year to year up to a maximum amount
of 200 days.
B. All part-time employees shall accumulate one hour of sick leave for
every 30 hours worked. The amount of such leave not taken shall accumulate
from year to year.
C. Any employee qualifying for compensation shall be paid for up to 1/2 of accumulated sick days at the rate of compensation set forth herein, but not to exceed the total sum of $20,000 (§
46-2, Compensation entitlement).

B. Compensation for sick leave upon retirement shall be paid in accordance with Police Agreement January 1, 2012, through December 31, 2015, as per §
46-7.1, Exceptions to leave policy, of the Municipal Code.

Vacation days shall begin to accrue upon commencement of employment,
but employees king to use vacation leave must be employed for a minimum
of three months prior to taking vacation leave. Eligibility for vacations
shall be computed on the first day of the month in which the employee
was hired. Vacations will be scheduled so as not to interfere with
the operations of the departments to which the employee is assigned.
The Borough will make every effort to accommodate vacation requests.
Vacation must be approved, in writing, by the relevant department
head or responsible Council member. If conflicts arise in vacation
requests, preference will be given to the employee who presents the
request first.

A. All
full-time nonunion permanent employees, 35 or more hours weekly, shall
be entitled to four personal leave days each year without deductions
from any other leave time permitted. Employees of the Public Works
Department shall notify the Supervisor of Public Works at least three
days in advance, and in his absence shall notify the Chairman of the
Public Works Committee. All other employees shall notify the Municipal
Clerk at least three days in advance.
B. If
less than three days' advance notice is given, entitlement to personal
leave shall be discretionary.
C. No
compensatory pay will be given if the personal leave days are not
taken, nor can said days be accrued.

The above sick, vacation and personal leave
shall not pertain to members of the Police Department. Police officers
shall be paid sick, vacation and personal leave in accordance with
the terms and conditions of employment contracts executed between
the municipality and officers or associations representing members
of the Police Department.

A. Holidays for full-time nonunion permanent employees.

(1) The following holidays will be observed by the Borough of Bay Head:

will be taken on Monday.
B. The following shall be recognized as holidays paid
at eight hours regular time to all full-time police officers:

(1) It is recognized by both parties that employees may
not, by reason of Department business, enjoy the above holidays by
working on those dates. The entire holiday benefit (104 annual hours)
shall be folded in and paid along with the regular payroll and utilized
for all computation purposes.
(2) Notwithstanding Subsection
B(1), above, any employee who is required to work on New Year's Day, Easter, Thanksgiving or Christmas shall be paid at a rate of 1 1/2 times the employee's regular hourly rate of pay.

The hospital, medical and dental insurance premiums, including
family coverage, of all full-time permanent municipal employees shall
be paid by the Borough of Bay Head. The Borough will provide health
benefit insurance for the employee and the employee’s family
in accordance with the State Health Benefits Program, as administered
by the Division of Pensions, Department of the Treasury, State of
New Jersey. The employee shall contribute 50% of the required contribution
at the highest level (Year 4) under Chapter 78, P.L. 2011 to the cost
of medical insurance. Payroll deductions for statutorily required
employee deductions shall be made in accordance with state law. The
municipality shall have the right, in its sole discretion, to select
the insurance carrier(s).

A. Nonunion employees.

(1) All nonunion employees listed under Section 1 of this ordinance whose yearly compensation rate is based upon a designated
number of hours per week, will be paid overtime consisting of time
and one half for hours worked in excess of the regular work day consisting
of eight consecutive hours and for hours worked in excess of 40 hours
in any one week. All such overtime is to be authorized by the Committee
Chairman.

(2) Compensation of four hours' minimum shall be paid to employees for
unscheduled work not occurring at the beginning or end of a regular
workday.

(3) Compensation of four hours minimum to be taken in compensatory time
off may be taken by the Municipal Clerk for attendance at Council
Meetings.

(4) Compensation of hours worked can be taken in compensatory time off
by the Planning Board Clerk for attendance at Planning Board meetings.

(1) All police officers shall be entitled to overtime
consisting of time and one-half for hours worked in excess of 40 hours
in any week. All such overtime is to be authorized by the Chief of
Police.
(2) At any time an employee is summoned for overtime duty,
he shall be entitled to be paid a minimum of four hours at the overtime
rate from the time of arrival.

A. Public Works full time employees shall not be entitled to a clothing
allowance. The Borough shall purchase clothing (five Borough tee shirts
with pocket, three winter sweatshirts, two pairs of work pants, and
two pairs of safety boots per year) and necessary safety equipment
for each full-time employee.

B. Police officers shall be entitled to an annual clothing allowance
and equipment of up to $1,200 for all permanent employees. The clothing
allowance and equipment shall be drawn on an as-needed basis upon
application to the Chief of Police and may not exceed the maximum
amount of the yearly allocated figure.

In the 2008 contract, court time allowance of $1,100 was added
to the salary of each policeman after increase and longevity, and
it was agreed that no future contract would have additional compensation
for court time. Accordingly, the Borough of Bay Head no longer provides
police personnel with additional compensation for attendance at court.

As per Ordinance No. 2008-19, equity adjustments were added
on the end of each policeman's salary and included in the base for
the years 2009, 2010 and 2011 to increase base salary in recognition
of the cessation of certain additional items of compensation. The
Borough of Bay Head no longer provides police personnel with equity
adjustments on their salaries.

All provisions of any employment agreement between
the municipality and an officer or an association representing officers
of the Bay Head Police Department are incorporated, as if fully set
forth, in this chapter.
