The owner of every residential, commercial or industrial building or structure located within the Borough of Bay Head shall connect the plumbing facilities of said building or structure with the sanitary sewerage system of the Borough of Bay Head.
As used in this chapter, the following terms shall have the meanings indicated:
OUTLET FIXTURE
An inside or interior outlet which is hooked into the sanitary sewerage system of the Borough of Bay Head.
SEWER LATERALS
The sanitary sewer pipe running from the building or structure to the connection at the sewer main located within a borough street, road, easement or other way.
It shall be the responsibility of the property owner to install, repair, clean, replace and maintain any sewer lateral connecting a building or structure located on his or her property to the sewer main of the sanitary sewer system of the Borough of Bay Head.
The rents, rates, fees and charges for the use of the services and facilities of the sanitary sewerage system of the Borough of Bay Head shall be as set forth in the fee schedule on file at the office of the Municipal Clerk.

User charges set forth in this chapter shall be reviewed annually by the Borough of Bay Head to reflect actual operation and maintenance costs, including replacements, and debt service.
There shall be no connection of sump pumps, downspouts, cellar drains of any kind or swimming pools to the sanitary sewer system of the Borough of Bay Head.
The annual rates and charges set forth herein shall be due and payable in full on the first day of July of each year. In the event that any rate or charge is not paid within thirty (30) days from the date when due and payable, said rate or charge shall be considered delinquent and sewer service to the customer having a delinquent account may be discontinued without notice. Delinquent sewer accounts shall be subject to an interest charge at the rate of eighteen percent (18%) per annum.
Newly constructed buildings and structures connecting to the sanitary sewerage system of the Borough of Bay Head shall be liable for a pro rata charge for the year in which the connection is made, beginning with the first day of the month following the date of connection.[1]

Any property owner having a sewer lateral connected to a sewer main within the municipality shall permit a designated agent of the municipality to inspect, check and test the sewer lateral to determine if there is improper infiltration or a prohibited connection to the sewer lateral.
Unless otherwise specified herein, for a violation of any provision of this chapter, the maximum penalty, upon conviction thereof, shall be a fine not exceeding one thousand dollars ($1,000.) or imprisonment for up to ninety (90) days or a period of community service not exceeding ninety (90) days, or any combination thereof.
