Recyclable materials are designated below:
A. 
"Aluminum" shall mean recyclable aluminum cans, clean aluminum foil, and clean aluminum foil-like containers, i.e., pie plates.

B. 
"Tin" shall mean steel, tin, bi-metal beverage and food cans.
C. 
"Glass beverage containers" shall mean all products made from silica or sand, soda, ash and limestone, the product being transparent or translucent and being used for the packaging or bottling of various matter and all other materials commonly known as glass but excluding, however, blue and flat glass commonly known as "window glass."
D. 
Corrugated cardboard is to be collected from residential and commercial establishments.

E. 
"Ferrous scrap" shall mean all metal scrap containing steel and/or cast iron.
F. 
"White goods" shall mean refrigerators, stoves, washing machines, dryers, water heaters, microwaves, and such other items as shall be listed in the rules and regulations propounded by the Borough of Bergenfield.

M. 
Construction and demolition debris: source-separated nonputrescible recyclable material generated from the construction, alteration, repair, maintenance and/or demolition of structures within Bergenfield. This material shall include concrete, bricks, block, ferrous and nonferrous metal, asphalt, asphalt shingles, recyclable wood scrap, and any and all other material generated from the construction, alteration, repair, maintenance and/or demolition of a structure or structures within Bergenfield.

N. 
"Batteries" shall mean automobile batteries and rechargeable batteries.

O. 
"Cartons" shall mean gable-topped and aseptic cartons (i.e., milk, soup, juice).

P. 
"E-waste" shall mean only the following: computers, computer monitors, laptops, tablets, televisions (TVs), desktop printers and desktop telefax machines.

A. 
Article I, Recyclable Paper, of this chapter shall remain in full force and effect.
B. 
All persons, except those physically disabled, who are owners, lessees or occupants of residential, commercial and institutional properties in the Borough of Bergenfield shall separate leaves, grass clippings, branches, vegetative yard waste, newspapers, magazines, office grade paper, mixed paper, aluminum, tin, glass, plastic bottles, cartons, e-waste, batteries, white goods, oil and antifreeze and construction and demolition debris and ferrous metals from any other trash and garbage generated by said persons, and they shall separately prepare the aforesaid described recyclable items in accordance with all applicable rules and regulations propounded by authority of this article.

C. 
Residential and commercial establishments shall separate, in addition to the items listed in § 266-18 of this article, corrugated cardboard from any other trash and garbage produced by them and shall prepare said corrugated cardboard in accordance with all applicable rules and regulations propounded by authority of this article.

D. 
Beginning September 1 to December 31 of each year, it shall be mandatory for all persons to separate leaves from all solid waste by depositing said material at the curbside for collection in accordance with the rules and regulations promulgated by the governing body. Leaves shall not be placed in any bags or containers of any kind.
E. 
Beginning January 1, 1994, it shall be mandatory for all commercial establishments to also separate high-grade white paper, mixed paper and construction and demolition debris from all solid waste by depositing said material at the curbside (except for construction and demolition debris which shall be recycled by private scavengers) for collection in accordance with the rules and regulations promulgated by the governing body.
F. 
Commercial establishments must report to the Municipal Recycling Coordinator, no later than January 15 of each year, the weights of materials recycled by private scavengers during the previous year.
(1) 
The report must contain the following information for each item recycled:
(a) 
Name of scavenger.
(b) 
Principal place of business.
(c) 
A description of the recyclable materials which are collected from each property.
(d) 
The quantity of each such recyclable materials collected.
(2) 
The data submitted in this report should agree with the information furnished by each scavenger as required by § 266-24 of this article.
G. 
Disposal of liquid waste materials. Residents will be required to purchase disposal tickets of $0.25 per quart of oil and $0.25 per gallon of antifreeze for the disposal of these materials between the hours of 8:00 a.m. and 3:00 p.m., Monday through Friday, at the DPW Office. All other liquid waste materials are prohibited. Anyone disposing of these products without the proper disposal ticket or disposing of other types of oil or chemicals at the DPW or at any municipally owned property in the Borough of Bergenfield shall be in violation of this article and will be subject to the prescribed penalties.
H. 
Residential establishments shall separate, in addition to the items listed in § 266-18 of this article, household-generated batteries, and all batteries shall be dropped off at the Borough depot or held for periodic county collections, in accordance with all applicable rules and regulations propounded by authority of this article.
I. 
Recyclables must be empty and rinsed clean.

J. 
No plastic bags allowed in curbside or recycling center commingled or single-stream recycling.

The Municipal Recycling Coordinator shall promulgate reasonable rules and regulations and establish the commencement dates for mandatory separation of recyclables and the manner, dates and times for the collection of same in accordance with the terms of this article. Any such regulations so promulgated shall become effective only upon approval by the Borough Council and may be changed, modified, repealed or amended in whole or in part by the Borough Council. A copy of the regulations promulgated by the Municipal Recycling Coordinator, as approved, modified, or amended, shall be available for public inspection at the office of the Borough Clerk during regular office hours.
From the time of placement at the curb for pickup, collection and recycling, recyclables shall be the property of the Borough of Bergenfield or its duly authorized agent. No person unauthorized by the Borough of Bergenfield shall collect or pickup or cause to be collected or picked up any such recyclables. Each collection or pickup of recyclables in violation hereof shall constitute a separate and distinct offense.
No provision herein shall be construed to prohibit groups or individuals who shall be authorized by the Municipal Recycling Coordinator from collecting or picking up recyclables at curbside or otherwise in such manner and under such terms and conditions as shall be prescribed by the Municipal Recycling Coordinator. No such collection or pickup shall conflict or interfere with pickup and collection by the Borough or its duly authorized agents.
A. 
Any scavenger performing private collection of recyclable materials within the Borough of Bergenfield shall register annually with the Recycling Coordinator. At the time of registration, such scavenger shall furnish the Recycling Coordinator with the following information:
(1) 
Name of the scavenger;
(2) 
Principal place of business; and
(3) 
Name and address of any person holding a 10% or greater interest in the scavenger's business.
B. 
Each scavenger shall complete and furnish to the Recycling Coordinator a monthly statement of recyclable materials collected with the Borough of Bergenfield which contains:
(1) 
A list of properties within the Borough of Bergenfield from which recyclable materials are collected;
(2) 
A description of the recyclable materials which are collected from each property;
(3) 
The quantity of each such recyclable materials collected;
(4) 
The name and location where each such recyclable material is deposited after collection;
(5) 
Such other information as may be reasonably required by the Recycling Coordinator.
C. 
No person shall collect any materials within the Borough of Bergenfield unless such person has registered with the Recycling Coordinator in accordance with the provisions hereof.
D. 
Notwithstanding anything to the contrary set forth herein, recyclable materials generated within the Borough of Bergenfield may be deposited in the appropriate containers or within the location specified at such recycling centers as may be established by the Borough of Bergenfield during the hours of operation thereof as provided by the rules and regulations.
Any person violating this article or any of the rules and regulations promulgated hereunder shall be liable or subject to a fine not to exceed $1,000 or jail term not to exceed 90 days, or both. In the event of a second offense, the minimum fine shall not be less than $100.
