It shall be the duty of the owner, tenant or person having charge of any land within the Township of Bridgewater, in the County of Somerset, whereon any land filling is being carried on, to cause the operation to be maintained in such manner that:
A. 
No organic, combustible, industrial waste or odoriferous matter constitutes any part of the landfill.
B. 
No bulky waste material which may furnish rat harborage is incorporated into the landfill.
C. 
All substances, other than rock or earth, constituting any part of the landfill are covered with at least six inches of earth at the close of each day's operation.
D. 
Surface water is properly drained or treated with effective chemicals so as to prevent mosquito production and odors.
E. 
Dust control is effected by spraying or otherwise treating all filled areas.
F. 
All filled areas are completed with a final earth covering for surface and side slopes, compacted and maintained at a depth of not less than 24 inches.

A. 
The provisions of § 125-1 shall not operate to diminish the force and effect of any restrictive provision of the Bridgewater Township Zoning Ordinance, as adopted February 22, 1962, and as from time to time amended and supplemented.[1]

B. 
The provisions of § 125-1 shall not extend to land within the M-2 General Industrial Zone, as from time to time established under the Bridgewater Township Zoning Ordinance, when the land-filling operation is limited to the disposal or storage of industrial waste materials or matter generated by reason of the manufacturing processes or industrial activities carried on upon the land and premises, including any contiguous lots devoted to the same manufacturing processes or industrial activities, upon which such land-filling operation is located, and when the land-filling operation is incidental to such manufacturing processes or industrial activities and such land-filling operation complies with all of the pertinent requirements of the Bridgewater Township Zoning Ordinance, as adopted and as from time to time amended and supplemented.
Compliance with the above regulations set forth in § 125-1 hereof shall not be construed as to permit the carrying on of a sanitary landfill for the purpose of disposal of refuse, garbage, ashes and rubbish, and such operation is hereby expressly prohibited within the Township of Bridgewater except insofar as the same may be authorized by any ordinance of the Township of Bridgewater providing for and regulating a sanitary landfill for the disposal of refuse, garbage, ashes and rubbish.

No provision of this chapter, as passed on April 17, 1961, and as amended and supplemented, shall be construed to operate to limit or infringe upon the governmental powers of the Township of Bridgewater, in the County of Somerset, a body politic and corporate of the State of New Jersey, and the government of said Township is expressly made exempt from the provisions of this chapter, as passed on April 17, 1961, and as amended and supplemented.

Any person who shall violate any provision of this chapter shall, upon conviction, be punishable by a fine not to exceed $500 or by imprisonment of not more than 90 days, or both, in the discretion of the Municipal Judge, and each day's failure to comply with any provision of this chapter shall constitute a separate violation.
