As used in this chapter, the following terms shall have the meanings indicated:
OPEN FIRE
Any outdoor fire or other smoke-producing process, other than a charcoal fire used for cooking, from which air contaminants are admitted directly into the outdoor atmosphere.
A. 
No person shall burn or cause, suffer, allow or permit in an open fire the burning of garbage, rubbish or refuse, as defined by NYCRR § 215.1.
B. 
No person shall kindle or maintain a fire when prohibited by a police officer or the Chief or Assistant Chief of any regularly organized Fire Company or Department in the Village of Angola, when such police officer, Chief or Assistant Chief has determined that atmospheric conditions or local circumstances make such fires hazardous or a nuisance to property or persons, and when so ordered by such police officer, Fire Chief or Assistant Chief.
C. 
It shall be unlawful for any person to conduct an open fire unless:
(1) 
The material used for the open fire is wood in its natural state;
(2) 
The area of the base of the burning material is not greater than 2.25 square feet;
(3) 
The height of the burning material is not greater than two feet;
(4) 
The open fire is kindled or maintained not less than 15 feet from any structure;
(5) 
Adequate provision is made to prevent the open fire from spreading;
(6) 
The open fire is attended at all times; and
(7) 
The open fire is located on private lands with the consent of the owner of said private lands.
Any person who violates this chapter shall be subject to a fine not to exceed $500.
