A mobile home lot may be located in any area in the Town of Barton,
outside of the Village of Waverly.
No changes shall be made to a mobile home lot or mobile home, which
will make the mobile home lot or mobile home in violation of this chapter
or any other applicable code, law, rule, regulation, ordinance or local law.
All mobile homes hereafter placed on any mobile home lot shall conform
to and comply with all applicable mobile home construction requirements in
effect as of the date of manufacture of the mobile home lot.
All mobile home lots (not in a mobile home park) shall be at least two
acres in size and must have sufficient width and depth to completely surround
a circle with a one-hundred-fifty-foot diameter.
Mobile homes and mobile home stands shall not be installed closer than
the greater of 50 feet from the edge of the right-of-way of the road or 75
feet from the center line of such road and no closer than 25 feet from any
side lot line.
Each mobile home lot shall be provided with a mobile home stand and
mobile home support system constructed according to the provisions of this
chapter. Mobile homes shall be installed on the mobile home stand and mobile
home support system according to the provisions of this chapter.
Each mobile home owner shall be required to enclose the bottom portion
of the mobile home with a metal, vinyl, painted pressure-treated wood or other
water-resistant material, properly ventilated, within 60 days of placement
on the mobile home stand. No skirt shall be required where a perimeter foundation
(masonry eight inches in width) fully encloses the area between the mobile
home and ground level.
Portable storage buildings of at least 140 square feet shall be a manufactured
or kit-type or be professionally designed and built. Permanent storage buildings
require a building permit and must meet the setback requirements outlined
in this chapter.
Attached or freestanding carports and awnings must be either commercially
manufactured and installed, professionally designed and built or comply with
the New York State Uniform Fire Prevention and Building Code.
Steps and decks must be either commercially manufactured and installed,
professionally designed and built or comply with the New York State Uniform
Fire Prevention Building Code.
All solid fuel installations must be approved by the agency having jurisdiction
thereof, and the owner of the mobile home shall apply for and obtain all required
approvals.
Secondary additions to mobile homes must be commercially manufactured
and installed as if professionally designed and built or must conform to the
New York State Fire Prevention and Building Code. For all secondary additions,
exterior design and construction shall be compatible with the existing home
exterior sheathing and roofing treatment.
For each mobile home on a mobile home lot, one parking space shall be
provided. Such space and the required access driveway shall be the same as
required for a single-family dwelling by general accepted standards.
As set forth in §
135-1 of the Code of the Town of Barton, no outdoor storage of inoperable machinery, appliances, unlicensed or inoperable vehicles or trailers or similar items shall be permitted. All such items shall be stored in approved storage buildings or inside enclosed carports.
Each mobile home stand shall be connected to a septic system which will
be used for that mobile home located on said stand and only one other mobile
home on a separate mobile home stand and mobile home park lot.
Every mobile home lot and mobile home stand shall comply with the National
Electrical Code and NFPA and all the requirements of the public utility furnishing
electricity to the site. All fuel supply and storage systems shall be installed
and maintained in accordance with all applicable codes, laws, rules and regulations,
ordinances and local laws governing such systems.
A. Natural gas or propane. Mobile home stands with natural
gas or propane shall have an approved manual shutoff valve. The gas outlet
shall be equipped with an approved cap to prevent accidental discharge of
gas when the outlet is not in use. All natural gas supply systems shall be
installed and maintained in conformity with the public utility company standards.
B. Other gas.
(1) Mobile homes provided with liquefied petroleum gas systems
shall have approved safety devices to relieve excessive pressure and shall
discharge at a safe location.
(2) Such systems shall have at least one accessible approved
manual shutoff valve located outside of the mobile home.
(3) All piping shall be well supported and protected against
mechanical injury.
(4) Storage tanks shall not be less than 100 pounds and be
located not less than five feet away from any exits.
C. Fuel oil.
(1) Mobile homes with fuel oil storage tanks shall have the
tanks securely supported and fastened in place.
(2) Tanks shall be equipped with permanently installed and
secured piping.
(3) Tanks shall be of at least 275 gallons' capacity.
All mobile homes placed on mobile home lots after the enactment of this
chapter shall be a minimum of 720 square feet, i.e., 12 body feet wide by
60 body feet long.
A. Occupants of mobile homes shall comply with the requirements
of this chapter and shall maintain the mobile home lot, facilities and equipment
in good repair and in a clean and sanitary condition.
B. Sufficient garbage containers with tight-fitting covers
shall be utilized for the storage and disposal of garbage, and no mobile home
manufactured prior to 1976 shall be permitted to be placed on any mobile home
lot or in any mobile home park.
