As used in this chapter, the following terms
shall have the meanings indicated:
MULTIPLE DWELLING or APARTMENT HOUSE
A residence building accommodating two or more families living
independently of each other and with independent facilities to do
their own cooking on the premises.
All elevators in multiple dwellings shall be
constructed and maintained in accordance with the New York State Uniform
Fire Prevention and Building Code.

All elevators in multiple dwellings shall be
inspected and tested regularly at intervals not exceeding 12 months
by a qualified independent inspector selected by the owner of such
multiple dwelling and approved by the Village.
Written proof of each such inspection and testing
shall be filed with the Village Clerk not less than 10 days thereafter.
Such written proof shall contain a statement signed by the person
conducting such inspection and testing, certifying that each such
elevator complies in all respects with the New York State Uniform
Fire Prevention and Building Code.

Each and every violation of, or failure to comply with, any
provision of this chapter shall constitute a violation, punishable
as follows: for a conviction of a first offense, by a fine not more
than $250, or imprisonment for a period not to exceed 15 days, or
both such fine and imprisonment; for a conviction of a second offense,
both of which were committed within a period of five years, by a fine
not less than $250, nor more than $500, or imprisonment for a period
not to exceed 15 days, or both such fine and imprisonment; and for
a conviction of a third or subsequent offense, all of which were committed
within a period of five years, by a fine not less than $500, nor more
than $1,000, or imprisonment for a period not to exceed 15 days, or
both such fine and imprisonment. Each and every day on which any such
violation or failure occurs or continues shall constitute a separate
violation.
