[HISTORY: Adopted by the Board of Trustees of the Incorporated Village of Bayville 9-14-1981 by L.L. No. 6-1981. Amendments noted where applicable.]
This chapter shall apply to all new and existing nonresidential sites that have a parking area for 20 or more vehicles, including but not limited to shopping centers, office buildings, warehouses, storage buildings, convalescent homes, schools and public buildings.
After establishment of specially marked parking spaces for handicapped persons, no person shall park a motor vehicle in such space, unless a handicapped person is either a passenger, driver or occupant of the vehicle and the vehicle contains a designation issued by the Commissioner of Motor Vehicles, pursuant to § 1203-a of the Vehicle and Traffic Law, which shall be displayed as required by the above statute.
A. 
On each site having parking spaces for at least 20 vehicles, but not more than 25 spaces, at least one shall be specifically designated and reserved for handicapped parking. Additional spaces for handicapped parking shall be in accordance with the following:

B. 
For all sites having total parking spaces in excess of 100, the number of handicapped spaces shall be determined by the Superintendent of Public Works.
C. 
Parking spaces for handicapped persons shall be located as close as possible to elevators, ramps, walkups and entrances and shall be so located that the handicapped person is not compelled to wheel or walk behind parked vehicles to reach entrances, ramps, walk-ups and elevators.
D. 
The exact location of parking spaces shall be designated by the Superintendent of Public Works.
E. 
At the request of the owner of the North Wind Shopping Center, Bayville Avenue, Bayville, there having been determined by the Village Superintendent of Public Works that there is total parking in said site for more than 76 spaces, there shall be at least four handicapped parking spaces at said shopping center site.

A. 
Each space designated for handicapped parking will be not less than 15 feet wide, including three feet of crosshatch, unless the same would create a nonconforming condition, in which event the existing parking stall width shall be applicable.
B. 
Each space shall be designated by signs with white lettering against a blue background and bearing the wording "Handicapped Parking State Permit Required." Such signs shall be erected, installed and maintained by and at the expense of the owners, operators, lessees or tenants of said site. If a sign and markings called for hereunder are not installed within 30 days after written request by the Incorporated Village of Bayville, the Village may proceed to install same and impose the cost thereof upon the owner of the site.
