Editor's Note: Former Article III of the 1981
Code, Residence A District, was repealed 11-25-1985 by L.L. No. 12-1985.
The property zoned Residence A was changed to Residence C District
and Residence E District 9-30-1985 by L.L. No. 11-1985. Local Law
No. 12-1985 also provided as follows:
"That with respect to the Real Property which
was the subject of Local Law No. 11-1985, that in the event of a fire,
flood, hurricane or other Act of God not caused to any degree by the
willful acts of the owner or agents, of such real property, that the
owner or owners, or their surviving spouses, of real property which
was the subject of said Local Law No. 11-1985 of the Village of Bayville,
shall have the right to build or rebuild on said real property a one-family
residence, substantially similar to the damaged or destroyed building
within two years of said catastrophe, providing all building plans
and specifications are complied with, notwithstanding the changes
of zone in said Local Law No. 11-1985 of the Village of Bayville."
"That with respect to the real property which
was the subject of Local Law No. 11-1985, that in the event the owner,
as of September 30, 1985 the date of enactment of such Local Law of
any parcel of real property with residence thereon, should own, whether
in single or separate ownership or otherwise, on said September 30,
1985, an unimproved building lot adjacent to said improved residential
lot or parcel, then the right of said property owner, his or her spouse,
or any purchaser in good faith from said owner or spouse to build
a one-family residence upon said unimproved building lot shall remain
intact, providing all building plans and specifications are complied
with, notwithstanding any provisions of Local Law No. 11-1985 to the
contrary."
