A. 
The General Assembly of the Commonwealth of Pennsylvania has enacted Act 60 of 1995,[1] setting forth guidelines and limitations for the compensation of Supervisors of townships of the second class.

B. 
Said Act provides that Supervisors of townships having a population of up to 4,999 persons shall be compensated in an amount not to exceed $1,875.
C. 
The population of Birmingham Township, as of the 1990 census, was approximately 2,636.
D. 
The General Assembly by said Act 60, authorizes the Board of Supervisors of the various townships of the second class to determine the compensation of Supervisors, subject to the limitations set forth in the Act.
E. 
It is the intention of the Board of Supervisors of Birmingham Township to set the compensation for Supervisors on a per-meeting basis within the limitations of Act 60.

Each Supervisor of Birmingham Township elected or appointed to office on or after January 1, 1996, shall receive compensation for attending duly advertised, general or special public meetings and/or hearings of the Board of Supervisors in an amount equal to the maximum amount permitted by the laws of the Commonwealth of Pennsylvania as the same may be amended from time to time. As of the date of adoption of this section, the compensation for each Supervisor is set at $1,875 per annum with said salary being automatically amended to the maximum amount as permitted by law without the necessity of further ordinance adoption.

No Supervisor shall receive annual compensation under this article in excess of the annual statutory limits set by the General Assembly in Act 60[1] for Supervisors of townships within the appropriate population category.

No Supervisor shall receive compensation in addition to the maximum permitted by the laws of the Commonwealth of Pennsylvania, as amended from time to time, for attending any special, other or additional meetings and/or hearings of the Board of Supervisors other than the compensation herein provided; such absences of compensation shall not negate or in any way affect such Supervisor's duty or obligation to attend such uncompensated meetings and/or hearings.
Where a hearing and/or meeting is conducted contemporaneously, immediately prior to or immediately subsequent to another hearing and/or meeting, such attendance shall be deemed to be only one meeting and/or hearing for compensation purposes.
