No person shall cast, place or deposit or cause to be cast, placed or deposited upon any street, alley, sidewalk, gutter or public grounds within the Village any timber, wood, ashes, rubbish, offal, vegetables, paper, shavings, grass or earth or any thing or substance whatsoever which may obstruct any street, alley, sidewalk, gutter or public grounds or impede travel, or which shall or may injure or disfigure the same, or tend to the injury or disfigurement thereof, or tend to render the same unclean or a nuisance, and no person shall obstruct or stop the flow of water in any manner in any ditch, sewer, gutter or culvert in, along or across any street, lane, alley or public grounds in the Village. Wherever any of the foregoing conditions are found to exist, the Police Department shall immediately notify the person or persons responsible for such condition to remove or abate such condition at once, and upon failure to do so the Village shall do the same and the cost of such work shall be recoverable from the person or persons responsible. In addition to the costs for removing or abating such conditions, the person or persons responsible shall be subject to the penalty provided in §
268-6.
Except as otherwise provided, any person who shall violate any provision of this chapter shall be subject to the penalty provided in Chapter
1, §
1-4, of this Code. Each violation and each day a violation continues shall constitute a separate offense. This section shall not preclude the Village from maintaining any appropriate action to prevent or remove a violation of this chapter.
