Upon adequate demonstration by the applicant or upon the Planning Board's
own motion, any or all of the requirements of this chapter may be waived,
if in the reasonable judgment of the Planning Board the proposed project or
land use activity is of such a nature as will not require a complete environmental
impact statement. The recommendations of the Township Environmental Commission
and/or Township Engineer may form a basis for such waiver determination.
Whenever, in the course of administration and enforcement of this chapter,
it is necessary or desirable to make any administrative decision, then, unless
other standards are in this chapter provided, the decision shall be made so
that the result will not be contrary to the spirit and purpose of this chapter
or injurious to the environment.
Any person engaging in or causing other persons to engage in a use or activity to which this chapter applies without submitting and having approved an environmental impact statement, or for the breach of any lawful condition imposed upon such approval, or for the violations of any other provision of this chapter, shall be subject, upon conviction of each and every violation, to the penalties in Chapter
1, Article
II, General Penalty. Each and every day that such violation continues, it shall be considered a separate and specific violation of this chapter.
