In accordance with the provisions of statute, the International
Property Maintenance Code/2018 (hereafter "Code"), and as may be amended
from time to time hereafter, is hereby adopted as a standard governing
the maintenance of premises within the Township.
The following provisions of the Code are amended and revised:
A. Section [A] 101.1 Title, (page 1, second line). Insert: Township
of Freehold.
B. Section [A] 103.5. Deleted.
C. Section [A] 106.4 Violation penalties, as set forth in this code is deleted in its entirety and replaced with the following: Any person who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, shall upon conviction, be subject to the penalties as set forth in Chapter
1, Article
II, General Penalty, of the Code of the Township of Freehold.
D. Section 107 Notices And Orders, as set forth in this code is deleted
in its entirety and replaced with the following: Whenever the Code
Official determines that there are reasonable grounds to believe that
there has been a violation of this code or has grounds to believe
that a violation has occurred, notice shall be given for the alleged
violation to the person or persons responsible therefor as hereinafter
provided. The notice shall:
(2) Include a description of the real estate sufficient for identification;
(3) Include a statement of the violation(s) and reasons why it is being
issued;
(4) Include an order of correction allowing a reasonable time for the
performance of any act it requires;
(5) Include a statement of the Township's right to file a lien in
accordance with Section 106.3;
(6) Be served upon the owner or his agent, or the occupant, as the case
may require, provided that notice shall be deemed to be properly served
upon such owner or agent, or upon such occupant, if a copy thereof
is served upon him personally; or if a copy thereof is sent by certified
mail to his last known address; or if a copy thereof is posted in
a conspicuous place in or about the dwelling affected by the notice;
or if he is served with such notice by any other method authorized
or required under the laws of this state. The notice may contain an
outline of remedial action which, if taken, will effect compliance
with the provisions of this chapter and with rules and regulations
adopted pursuant thereto.
E. Sections 108, 109, 110, 111, & 112. Deleted.
F. Section 302.4 (page 11, line 2). Insert: 10 inches.
G. Section 304.14 (page 13, line 1 & 2). Insert: May 1 and November
1.
H. Section 404.4 Bedroom and living room requirements, as set forth
in this code is deleted in its entirety and replaced with the following:
Every dwelling unit shall contain living room space, dining room space
(or combined living/dining room space), bedroom space and kitchen
space, and the number of occupants of every dwelling unit shall be
limited based on the square footage and maximum occupancy limitations
set forth in this chapter, including Table 404.5. Every room occupied
for sleeping purposes in a dwelling unit shall be classified as a
bedroom and shall not be used to satisfy the living room or dining
room requirements of Table 404.5.
I. Section 404.5 Overcrowding as set forth in this code is
deleted in its entirety and replaced with the following: Occupancy
of every dwelling unit is limited to the maximum permitted by the
bedroom space.
J. Section 602.3 (page 23, fifth line) Heat Supply. Insert: October
1 and June 1.
K. Section 602.4 (page 23, third line) Occupiable work spaces. Insert:
October 1 and June 1.
A copy of the International Property Maintenance Code has been
placed on file in the office of the Township clerk and will remain
there for the use and examination of the public.
To the extent any provision of the International Property Maintenance
Code is inconsistent with any other provision of the Code of the Township
of Freehold, the more stringent provision shall be applicable.
