Pursuant to § 87 of the Public Officers Law (Freedom of Information
Law) and the rules and regulations promulgated by the Committee on Public
Access to Records, the Board of Trustees of the Incorporated Village of Garden
City does hereby establish and adopt the following rules and regulations for
public access to records.
The Village Clerk, whose business address is 351 Stewart Avenue, Garden
City, New York, is hereby designated as the records access officer for all
records in the village, except for records kept in the following departments,
wherein the records access officer is hereby designated as set forth:

Records shall be available for public inspection and copying at the
office of the records access officer for the department where the records
are kept during regular business hours.
All requests for access to records shall be in writing on the forms
provided by records access officer and shall reasonably describe the record
or records sought.
No records may be removed by the requestor of records from the office
where the records are kept. In order to safeguard records, the records access
officer may, at his sole discretion, limit the number of documents which a
requestor may have before him for examination at any one time.
The Comptroller of the village, whose business address is 351 Stewart
Avenue, Garden City, New York is hereby designated as the individual to hear
appeals from denial of access to records. In the event that the Comptroller
has not made a written decision within five business days of the receipt of
the appeal, because of his continuous absence from the village, then the Mayor
of the village is hereby designated as the substitute individual to hear and
decide appeals.
Except when a different fee is otherwise prescribed by law, fees for
copies of records shall be as follows:
A. The fees for copies of records not exceeding nine by
fourteen (9 x 14) inches shall be $0.25 per page.
B. The fees for copies of records exceeding nine by fourteen
(9 x 14) inches and for records not reproduced on the premises shall be the
actual cost to the village.
