The purpose of this Article is to protect the village's water supply from being depleted and to conform to policies of the State Department of Environmental Conservation and Nassau County Ordinance No. 248-A-1987.
It shall be the duty and responsibility of the Director of the Department of Public Works of the village or his designated agent to enforce the provisions of this Article as hereinafter provided. Officers of the Garden City Police Department and all persons enumerated in § 4-1 of this Code shall be empowered to issue summonses or appearance tickets for any violation of the provisions of this Article.
Lawn sprinkling and garden irrigation of any outdoor lawn, field, garden, hedge, shrub or tree, whether by automatic system, manual sprinklers or hand watering, may be done only during the period from April 16 to November 30 each year. Such sprinkling shall be permitted only during the hours of 5:00 a.m. to 10:00 a.m. and 6:00 p.m. to 10:00 p.m.
All properties with odd-numbered addresses shall be permitted to sprinkle only on odd-numbered days of the month. All properties with even-numbered addresses or which do not have any street address shall be permitted to sprinkle only on even-numbered days of the month.
The following restrictions shall apply to automatic sprinkler systems:
A. 
All newly installed systems must have moisture sensors approved by the Department of Public Works.
B. 
All existing systems without moisture sensors approved by the Department of Public Works must be retrofitted by June 30, 1989.
C. 
All systems installed without a village permit must obtain such permit within one year from the effective date of this Article.
A. 
All home car washing must be done with hoses fitted with spray nozzles with automatic shut-off.
B. 
Use of water for washing down driveways or walkways is hereby prohibited.
C. 
No air-conditioning or cooling systems which utilize an open loop where water used in the system flows through the system only once shall be permitted. Any existing systems of this type shall be eliminated, be equipped with a water-recycling system or be converted to an air-operative system by June 30, 1988.
D. 
Fire hydrants shall not be operated or utilized without prior receipt of a license therefor from the Department of Public Works. The Department shall from time to time promulgate a schedule of fees for such usage. This subsection shall not apply to Fire Departments and units of local government.
E. 
Water shortage. Notwithstanding any other provision of this article, the Superintendent of Public Works is hereby empowered to declare a "water shortage" and issue a "water shortage declaration" as described herein, if the Superintendent determines that there is an insufficient supply of water available that meets all federal, state, and county water quality standards.

(1) 
The water shortage declaration shall be made in writing to the Mayor and posted on the Village website.
(2) 
The water shortage declaration shall include those additional water usage restrictions enumerated in Subsection (3) below that the Superintendent of Public Works deems appropriate to ensure an adequate supply of potable water and fire suppression capabilities, and to otherwise protect the health, safety, and welfare of Village water users.
(3) 
The water shortage declaration shall include one or more of the following temporary restrictions:
(a) 
A partial or complete ban on lawn sprinkling.
(b) 
A ban on filling private and/or public swimming pools.
(c) 
A ban on new water connections.
(4) 
The water shortage declaration and restrictions set forth therein shall be effective for 60 calendar days, unless renewed or withdrawn upon further notice to the Mayor and publication on the Village website.
(5) 
Penalties for violations. Any person, including any property owner, agent, contractor, landscaper, lessee, or tenant, who violates the restrictions contained in a water shortage declaration issued pursuant to this Subsection E shall be guilty of a violation of the Village Code. Each day shall constitute a separate violation which shall be subject to the following fines:
(a) 
A first violation shall be punishable by a fine of $2,000.
(b) 
A second violation shall be punishable by a fine of $3,000.
(c) 
A third violation, and all subsequent violations, shall be punishable by a fine of $5,000.
Nassau County Ordinance No. 248-A-1987 shall control with regard to matters not covered by this Article and with regard to any provision of this Article which is less restrictive than such ordinance.
If any section, subsection or provision of this Article or the application of such section, subsection or provision to any person or circumstances shall be held invalid, illegal or unconstitutional, the validity of the remainder of this Article and the applicability of such section, subsection or provision to other persons or circumstances shall not be affected thereby.
