Where the Planning Board finds that extraordinary and unnecessary hardships may result from strict compliance with these regulations, it may vary or waive the regulations so that substantial justice may be done and the public interest secured, provided that such variations will not have the effect of nullifying the intent and purpose of the Official Map, the Comprehensive/Master Plan or the Zoning Law.[1]

In granting variances and modifications, the Planning Board shall require such conditions as will, in its judgment, secure substantially the objectives of the standards or requirements so varied or modified.
A. 
If any provision, paragraph, word, section or term of this chapter is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections and terms shall not be affected and shall continue in full force and effect.
B. 
All other chapters, local laws or ordinances, and any parts thereof, which are inconsistent or conflict with any part of this chapter are hereby repealed to the extent of any inconsistency or conflict.
This chapter shall take effect immediately.
