This chapter provides minimum standards governing the condition and maintenance of nonresidential buildings. This chapter is intended to promote the public health, safety and welfare by prohibiting certain deficiencies in building maintenance that are not regulated by other state or local laws.
This chapter shall be applicable to all nonresidential buildings located in the Village of Scotia.
The owner or agent in control of a nonresidential building shall be responsible for maintaining the building in compliance with the provisions of this chapter.
A. 
Except where specifically defined herein, all words used in this chapter shall carry their customary meanings.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
BUILDING
Any structure having a roof supported by columns or walls and intended for a shelter, housing or enclosure of persons or chattel.
A. 
Exterior doors, windows, skylights and similar openings shall be maintained weathertight.
B. 
Exterior stairs, porches, entrance platforms, fire escapes and the railings thereon shall be maintained in a safe and sound condition.
C. 
Roofs shall be maintained in a watertight condition.
D. 
Exterior surfaces shall be maintained in a good, safe and sound condition. Surfaces not inherently resistant to deterioration shall be treated with a protective coating of paint or other suitable preservative.
E. 
Railings or parapet walls shall be provided at open sides of balconies, mezzanines, porches, accessible roofs, exit passageways, areaways, motor vehicle parking decks and ramps, and around floor openings.
F. 
Chimneys, smokestacks, flues, gas vents, smokepipes and connectors shall be maintained structurally safe and sound.
The Building Inspector is hereby authorized to enforce the provisions of this chapter.
Any person, firm or corporation violating any provision of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $250 or imprisonment for a term not exceeding 15 days, or both.
