No person shall discharge any gun, revolver, pistol, rifle, shotgun
or other firearm or within the Village of Scotia, New York.
The prohibition contained in §
140-1 of this Article shall not apply to any of the following:
A. Discharge of firearms in self-defense or in defense of
property.
B. Discharge of birdshot from shotguns by the owner of property
on his own land to protect growing crops from birds and vermin, provided that
such discharge is not otherwise prohibited by the laws of the State of New
York.
C. Discharge of firearms by a peace officer in the discharge
of official duty.
D. Discharge of firearms wholly within a building which
is equipped with facilities specifically designed to prevent bullets or other
projectiles discharged from firearms from escaping the building, so long as
no such bullet or projectile discharged from a firearm within the building
does escape therefrom.
E. Discharge of blank cartridges for athletic events.
Any person, firm or corporation violating any provision of this Article
shall, upon conviction thereof, be punishable by a fine of not more than two
hundred fifty dollars ($250.) or imprisonment for a term not exceeding fifteen
(15) days, or both.
It shall be unlawful for any person to use or discharge an air gun or
other gas gun or a spring gun or any other instrument or weapon in which the
propelling force consists of a spring or gas, including air, or any bow and
arrow, compound bow or crossbow within the Village of Scotia.
Use or discharge of weapons or instruments described in §
140-4 of this Article shall not be unlawful by virtue of said section where:
A. Such use or discharge takes place wholly within the confines
of a building and the person using or discharging such instrument or weapon
is doing so with the knowledge and consent of the owner or tenant of the building
and the entire flight of any projectile propelled from an instrument or weapon
takes place within the building and such projectile comes to rest therein.
B. The weapon or instrument discharges no projectile or
discharges only water or discharges only wooden, plastic or cork projectiles,
the flight of which does not exceed thirty (30) feet.
Any person, firm or corporation violating any provision of this Article
shall, upon conviction thereof, be punishable by a fine of not more than two
hundred fifty dollars ($250.) or imprisonment for a term not exceeding fifteen
(15) days, or both.
