It is the intent of this chapter to protect the public, health, welfare
and good order of the community. The protection and preservation of the home
and residential privacy is recognized as having a significant governmental
interest; that requires that members of the community enjoy in their homes
and dwellings a feeling of well-being, tranquility, and privacy, and when
absent from their homes and dwellings, carry with them the sense of security
inherent in the assurance that they may return to the enjoyment of their homes
and dwellings; further, that the practice of picketing before or about residences
and dwellings causes emotional disturbance and distress to the occupants;
and without resort to such practice, full opportunity exists and under the
terms and provisions of this chapter to provide for the exercise of freedom
of speech and other constitutional rights; and that the provisions hereinafter
enacted are necessary for the public interest to avoid the detrimental results
herein set forth. Further, there are substantial governmental interests in
minimizing interference with pedestrian and traffic movement and in assuring
pedestrian, traffic and public safety.
It is unlawful for any person to engage in picketing before or about
the residence or dwelling of an individual in the Village of Scotia.
Nothing herein shall prohibit:

A.
No person shall engage in, conduct, or carry on the activity
of picketing in a group of 15 or more individuals without notifying the Village
of Scotia Police Department in writing at least 48 hours in advance of such
picketing. Written notice may be given to the Police Department in person,
by mail, or by fax.

B.
Such written notice shall contain all of the following
information:
(1)
The name, address and telephone number of the person
submitting the written notice.
(2)
The name, address and telephone number of the headquarters
of the organization, if any, and of the organizer or responsible head of such
organization by whom or on whose behalf the picket is proposed to be conducted.
(3)
The name, address and telephone number of the contact
person or responsible person at the picketing site.
(4)
The location and date of the proposed picketing and route
to be traveled.
(5)
An estimate of the approximate number of persons who
will be participating in the picketing.
(6)
The approximate time at which the picketing will commence
and conclude.
Before a person may be arrested or cited for violating a provision of
this chapter, the person must have been ordered by a police officer to move,
disperse, or otherwise remedy the violation.
Any person who violates any provision of this chapter shall, upon conviction
thereof, be guilty of a violation and shall be subject to a fine not to exceed
$500 or imprisonment for a term not to exceed 15 days, or both.
