As used in this article, the following terms shall have the meanings indicated:
VEHICLE
For purposes of this article only, the term "vehicle" shall include all motor vehicles capable of registration under the New York Vehicle and Traffic Law, as well as off-road or all-terrain vehicles, trailers, carts, boats and other equipment capable of or outfitted to travel on roads or highways.
A. 
It shall be unlawful to park or display a vehicle for purposes of sale within the right-of-way of any highway, road, street, avenue, alley, public place, public highway or any other public way within the bounds of the Town of East Hampton, exclusive of the incorporated villages.
B. 
It shall be unlawful to park a vehicle for purpose of sale on any public or private property without prior written consent of the owner of said property, and said written consent shall be on file with the East Hampton Town Police Department 24 hours prior to said vehicle being offered for sale.
The display on or about the vehicle of any sign, sticker, writing or other indication that the vehicle is for sale shall be presumptive evidence that said vehicle is parked or displayed for purposes of sale.
Each day said vehicle is parked or displayed in violation of § 240-121 shall constitute a separate and distinct offense. In addition, a vehicle that is ticketed for a violation of § 240-121 and remains parked for purposes of sale for 24 hours thereafter shall be deemed an abandoned vehicle pursuant to New York State Vehicle and Traffic Law § 1224. Such constructive abandonment shall constitute "good cause" for removal of the vehicle by the Town pursuant to § 240-42.
A. 
Every person convicted of violating § 240-121 shall, for a first conviction thereof, be punished by a fine of not more than $100 or by imprisonment for not more than 15 days, or both such fine and imprisonment; for a second conviction within 18 months thereafter, such person shall be punished by a fine of not more than $200 or by imprisonment of not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months of the first conviction, such person shall be punished by a fine of not more than $300 or by imprisonment of not more than 60 days, or by both such fine and imprisonment.
