No person shall alter or disturb the grade of any Village street or open or excavate any street or highway within the limits of the Village of Florida without first procuring written permission therefor from the Mayor, to whom there shall be made a formal application. Each application must be signed by the applicant and submitted to the Mayor and is to contain a general description of the location, together with the dimensions, of the excavation, a statement of purpose for such proposed excavation and the period of time it is to remain open, and the applicant is to state therein that he will indemnify the Village for any damage resultant from injury to life, limb or property caused by such excavation. For each such excavation, there shall be made a separate application. There shall be presented to the Mayor with each application $100 to be held as a guaranty for the prompt restoration of the street or highway to its original condition, $50 of which shall be returned to the applicant upon order of the Mayor, provided that said street or highway shall have been replaced in good and proper condition after an inspection thereof, and $50 of which shall be retained for expenses.

Failure to obtain a permit as aforesaid shall be punishable by a fine of not more than $250 or imprisonment for a term not exceeding 15 days, or both.
