There shall be and there is hereby established
a Department of Public Works. There shall be a Commissioner of Public
Works, who shall be a member of the Board of Trustees and who shall
be appointed by the Mayor, subject to the approval of the Board of
Trustees, including the Mayor, for such term as the Board of Trustees
shall determine by resolution. He (or she) shall be the head of the
Department and have general jurisdiction over and control of the administration
of the Department of Public Works and shall have general supervision
over the duties performed by and charged by this article to the Department.

The Department of Public Works shall:
A. Have charge and supervision of the construction, reconstruction,
alteration, improvement, maintenance, repair, cleaning, snow removal
and lighting of all streets, passways, parking fields, buildings,
parks, playgrounds, sidewalks, storm drainage systems and structures,
beaches, docks, moorings and all other such structures and facilities
in the nature of public works under the jurisdiction of the Village.
B. Have charge and supervision of all engineering or
architectural contracts approved by the Board of Trustees for the
design of streets, passways, storm drainage systems or structures,
parking fields, sidewalks, parks, playgrounds, beaches, docks, moorings,
buildings and all other such structures and facilities in the nature
of public works under the jurisdiction of the Village.
C. Have charge and supervision of topographic and land
surveys and contracts approved by the Board of Trustees for Village
improvements.
D. Have charge and supervision of trimming all trees
on or along streets, passways, highways, parking fields, parks and
playgrounds under the jurisdiction of the Village.
E. Within appropriations therefor, make all purchases
of supplies, material and equipment for use of the Department, as
well as lease all equipment necessary to supplement that owned by
the Village.
F. Have charge and supervision of all contracts awarded
by the Board of Trustees for the construction, maintenance or repair
of all buildings owned or leased by the Village, parks, parking fields,
storm drainage systems and structures, beaches, docks, moorings and
streets and the paving and lighting of streets, passways and parking
fields and other such facilities under the jurisdiction of the Village.
G. Make recommendations to the Board of Trustees regarding
the dedication of streets laid out in the Village by an owner and
offered by him for dedication as public streets, as well as recommendations
relative to petitions for consideration by the Board of Trustees for
laying out, narrowing, altering, widening and discontinuing or accepting
the dedication of streets within the Village.
H. Have charge and supervision of all elements associated
with the collection of garbage and trash in the residential areas
of the Village, including the administration of contracts, billing
for garbage services and improving services associated with the collection
of garbage; shall see to the preparation of budgets and cost accounts
associated with the service; shall act as prime interface with contractor
collecting and dumping garbage; and shall conduct negotiations as
necessary to provide efficient and effective garbage services.

The Village Engineer shall be under the direction
of the Commissioner of Public Works or Commissioner of Building as
authorized by the Board of Trustees and shall perform such duties
as are given him by said Commissioner(s). The Village Engineer shall
be appointed or retained under contract by the Mayor and subject to
approval of the Board of Trustees under such conditions and at such
compensation as may be fixed by the Board of Trustees. The Village
Engineer shall be a professional engineer licensed by the State of
New York. If retained under contract, he may also engage in private
practice; provided, however, that he shall not appear, advise or be
interested, directly or indirectly, in any transaction or thing in
which the interest of the Incorporated Village of Port Jefferson is
in any way affected. If retained under contract, his office shall
not be in the civil service.
The Department Commissioner, the Department
head or any designated representative, deputy or employee of the Department
of Public Works may enter upon any lands or buildings, public or private,
within the Village for the purpose of making any inspections, surveys,
examinations or investigations necessary or convenient in the exercise
or performance of the duties charged to the Department by this article.
