A. 
No person, or persons, shall create, cause, or continue any unnecessary, unusual, loud, or disturbing noise within the Town of Vernon; or any noise which is of such character, duration, volume or intensity; as to unreasonably annoy, disrupt, or disturb the quiet, comfort, peace or repose of any reasonable person or such as to be detrimental to the life, health, safety or property of any person. For purposes of this chapter, a decibel level of greater than 65 dB when measuring from a common property line is evidence of noise that is loud or disturbing.
A. 
This chapter shall not apply to any noise or sound generated by, or resulting from any of the following:
(1) 
School-sponsored activities on the grounds of a public or private school.
(2) 
Athletic contests, or other activities, on Town of Vernon, county or state property expressly authorized or approved by the Town of Vernon, Waukesha County, and/or any state agency or department.
(3) 
Construction, repairs, maintenance, remodeling, demolition, grading, or other activities related to improvement of real property between the hours of 7:00 a.m. to dusk.
(4) 
Snow or ice removal operations.
(5) 
Any gardening, lawn care, tree maintenance or removal, or other landscaping activities between the hours of 8:00 a.m. to dusk.
(6) 
Church bells.
(7) 
Religious or political gatherings and other activities protected by the First Amendment of the United States Constitution.
(8) 
Activities for which the regulation of noise has been preempted by federal law.
(9) 
Refuse and sanitation collection operations.
(10) 
Emergency vehicle operations or activities and any other activities necessary for the protection or preservation of property or of the health, safety, life or limb of some person.
(11) 
Activities or events approved by the Town Board and any noise arising out of operation of Town vehicles.
(12) 
Any noise produced by, or as a result of, any person engaged in an agricultural enterprise unless otherwise explicitly prohibited in the Town of Vernon municipal code.
Penalties for a violation of this chapter shall be as described in Chapter 1, § 1-10 of this Code.
