The purpose of this chapter is to provide regulations for the
removal and disposal of garbage and recyclable materials from single-family
residences, duplexes, condominiums and multifamily complexes, as defined
herein, located within the Town in accord with state law.
This chapter is adopted as authorized under § 287.09,
Wis. Stats.
In their interpretation and application, the provisions of this
chapter shall be held to be minimum requirements and shall not be
deemed a limitation or repeal of any other power granted by the Wisconsin
Statutes. Where any terms or requirements of this chapter may be inconsistent
or conflicting, the more restrictive requirements shall apply. Where
a provision of this chapter is required by the Wisconsin Statutes,
or by a standard in Ch. NR 544, Wis. Adm. Code, and where the provision
of this chapter is unclear, the provision shall be interpreted in
light of the Wisconsin Statutes and the Ch. NR 544 standards in effect
on the date of the adoption of this chapter or in effect on the date
of the most recent text amendment to this chapter.
For the purpose of this chapter, the following words shall have
the meaning assigned to them:
MULTIFAMILY RESIDENCE
Any residential structure housing two, three or four families
in separated living units.
RECYCLABLES/RECYCLABLE MATERIAL
These materials include aluminum beverage containers, steel
and bimetal cans, newspaper, magazines, corrugated paper, or other
container board, office paper, plastic containers, foam polystyrene
packaging and glass containers. This list may be expanded to comply
with state, county, and municipal law and landfill disposal bans.
SINGLE-FAMILY RESIDENCE
Any single-family home, including trailers and/or a mobile
home unit where an individual or a family resides.
STATE
The State of Wisconsin.
TOWN
The Town of Vernon, Wisconsin, acting through its duly elected
Town Board or designated officials.
The Vernon Town Board shall contract for removal of refuse and
recyclables from single-family and two- to four-family dwellings.
There is hereby established a fee for the removal of refuse and recyclables
from single-family and two- to four-family properties. Said fee shall
be the per-unit charge made to the Town by the firm providing said
removal to the Town by contract and shall be paid monthly by the Town.
The cost of said contract shall be a budgetary item included in the
Town's general tax levy.
The collection and disposal of garbage and recyclable materials
shall be supervised by the Director of Public Works, who shall recommend
such regulations as are necessary regarding the collection and disposal
thereof.
The Town shall post the requirement of the refuse and recycling
program on the Town website and shall be available on request to residents
at the Town Hall.
Penalties for a violation of this chapter shall be as described in Chapter
1, §
1-10 of this Code.
