Editor's Note: Section 2 of Bill No. 97-47
provides that this Act is an emergency act and "necessary to give
the Core Service Agency Board the expertise to begin implementing
certain programs required by the State of Maryland by July, 1997,
and shall take effect on the date it becomes law."
A.
There is an Office of Mental Health Core Service Agency
of Harford County, Inc.
B.
The Agency is operated by a Board of Directors.
C.
The Board consists of thirteen members appointed by
the Board of Health.

The remaining members are:
(a)
A representative of the provider community;
(c)
Two County residents who are members of the
business community, one of which shall be:
(d)
A County resident licensed to practice law in
Maryland; and
(e)
Two County residents who have an interest in
the provision of mental health or addictions services in Harford County,
but are not providers.
D.
The term of an appointed member is 3 years. At the
end of a term, a member continues to serve until a successor is appointed
and qualifies. A member who is appointed after a term has begun serves
only for the rest of the term and until a successor is appointed and
qualifies.
E.
No person is eligible for succession as a Board member
after serving on the Board for 2 consecutive 3-year terms.
F.
Board members serve without compensation but may be
reimbursed for reasonable and necessary expenses incurred in the discharge
of their duties.
G.
From among its members, the Board annually shall elect
a Chairperson, a Vice-Chairperson, and a Secretary/Treasurer.
The Board shall:
A.
Be the initial recipient of all state and County funds
for mental health and addictions services in the County;
B.
Establish performance standards for service providers;
C.
Be responsible for monitoring the quality of mental
health and addictions services in Harford County;
D.
Contract for the delivery of mental health and addictions
services in Harford County;
E.
Establish and maintain a consumer information system
and referral service;
F.
Provide oversight of publicly-funded mental health
and addictions programs, including the establishment of quality assurance
and utilization review data for all grantees and subcontractors;
G.
Establish the policies and procedures of the Office
on Mental Health Core Service Agency of Harford County, Inc.;
H.
Annually review and approve the budget of the Office
on Mental Health Core Service Agency of Harford County, Inc.;
I.
Select and appoint the Executive Director of the Office
on Mental Health Core Service Agency of Harford County, Inc.;
J.
Annually review the performance of the Executive Director;
K.
Establish a conflict of interest policy for employees
of the Office on Mental Health Core Service Agency of Harford County,
Inc.
L.
Upon recommendation of the Director, appoint any other
necessary employees;
M.
Establish personnel policies for employees of the
Office on Mental Health Core Service Agency of Harford County, Inc.;
N.
Adopt bylaws for the conduct of its business;
O.
Report to the County Board of Health at least twice
a year;
P.
Issue by October 1 of each year a report regarding
the status of the mental health and addictions services in Harford
County;
Q.
Provide, with assistance from the Executive Director
and staff, all required fiscal, statistical, and narrative reports
to the State Mental Hygiene Administration, the Alcohol and Drug Abuse
Administration, and other agencies.
