It shall be unlawful for any person, corporation,
incorporated town, municipality, city, county or any other governmental
agency or governmental unit to dump or deposit any waste matter extracted
outside the county or originating outside the county, such as but
not limited to refuse, sludge, sewage, waste, solid waste, liquid
waste, septic waste or any other similar waste matter upon any land
or property within the boundaries of Harford County, Maryland.

It shall be unlawful for any property owner or any person who is in the possession of such property to allow any person, corporation, incorporated town, municipality, city, county, governmental agency or governmental unit to dump or deposit any waste matter on his property in violation of §
109-19 of this Article.

Exempt from the provisions of §§
109-19 and
109-20 of this Article are the municipalities, towns and incorporated towns located in Harford County, the Harford County government and any regional waste authority which includes Harford County.

A. Any solid waste extracted outside the county or originating outside the county for deposit in any disposal facility or resource recovery facility operated by or under contract for or on behalf of Harford County and located within Harford County shall be accepted upon payment of a disposal fee as provided for in §
157-28, provided that surcharges may be imposed on certain classes of solid waste requiring special handling in addition to the disposal fee.

B. To facilitate the enforcement of the requirements
of this section, the Director of Public Works is hereby authorized
to request routing maps, clientele lists, days of collection, truck
assignments and other pertinent information from users of facilities
operated by or for the county. Every user is required to supply this
information upon request, regardless of the type of vehicle being
used to haul the waste matter and regardless of whether the collection
is from private or commercial sources.
C. The Department of Public Works shall promulgate rules
and regulations to implement the provisions of this section.

A. Disposal of solid waste generated outside the territorial
limits of Harford County in violation of this Article is hereby declared
to be a misdemeanor. Any person, firm or corporation found guilty
thereof shall be fined an amount not exceeding one thousand dollars
($1,000.) or shall be imprisoned for a period not exceeding six (6)
months, or both fined and imprisoned. Each violation shall constitute
a separate offense.
B. In addition to the penalties provided for in Subsection
A above, the normal disposal fee established in accordance with §
109-22 shall be trebled where it is determined by a court of appropriate jurisdiction that a person, firm or corporation has deposited out-of-county solid waste in Harford County without paying the appropriate fees. All sums of money collected under this subsection shall be paid to the Treasurer of Harford County.
