All records of the Village of Alexandria Bay
shall be open to the public and subject to access by the public in
accordance with the rules and regulations set forth herein in accordance
with Article 6 of the Public Officers Law of the State of New York.
The Village Clerk of the Village of Alexandria
Bay is hereby designated as the Records Access Officer under the Freedom
of Information Act, Article 6 of the Public Officers Law of the State
of New York. All requests for records must be directed in writing
to the Village Clerk.
The Village Clerk, as the Records Access Officer
of the Village of Alexandria Bay, is required to respond to all written
requests for records within five business days of receipt of the request.
Such response shall specify whether or not access to the records may
be obtained and, if access is granted, when such access will be given.
In the event that access is denied, the Village Clerk, as Records
Access Officer, must specify, in writing, with particularity, the
basis on which such access is denied. Denial of access to records
may be based only upon those grounds set forth in Article 6 of the
Public Officers Law of the State of New York.
The Village Clerk, as Records Access Officer,
is authorized to copy any records required to be disclosed by law
and may charge a fee not to exceed $0.25 per page for copying, unless
the document required to be copied exceeds nine by twelve (9 x 12)
inches, in which case the Village Clerk, as Records Access Officer,
is allowed to charge to the applicant the actual cost of reproduction.
In all cases where reproduction of records is required, the Village
Clerk, as Records Access Officer, shall not reproduce such records
until payment is received.
Nothing in this chapter or Article 6 of the
Public Officers Law allows records to be removed from the custody
of the public officer charged with the duty of maintaining such records.
The Records Access Officer shall see that no public records are removed
from their lawful custodian.
