The existing Zoning Board of Adjustment of the
Borough of Brooklawn is hereby abolished.
All powers, duties and authority of the former
Zoning Board of Adjustment of the Borough of Brooklawn shall be and
is hereby transferred to the Planning Board of the Borough of Brooklawn.
All rules and regulations of the former Zoning Board of Adjustment
shall become the rules and regulations of the Planning Board and shall
be adopted and confirmed by the Planning Board and integrated into
the Planning Board Rules and Regulations, except as modified or amended
by the Planning Board.
In all cases where the Planning Board shall
hear applications for variances pursuant to N.J.S.A. 40:55D-7Od, the
Class I member of the Zoning Board (the Mayor) and the members of
Class III on the Zoning Board (members of the governing body) shall
not participate in the discussion or voting on said applications.
The positions of Zoning Board of Adjustment
Attorney, any experts retained by the Zoning Board of Adjustment and
staff employed by said Board shall be abolished and the duties and
functions of the same merged into and taken over by the Planning Board
Attorney and any experts or staff retained by the borough on behalf
of the Planning Board. The Planning Board may also employ or contract
for the services of experts and any other staff that it may deem necessary
to fulfill its additional duties under this Part 2.
All other ordinances and parts of ordinances
in conflict with or inconsistent with this Part 2 are hereby repealed,
but only to the extent of such conflict or inconsistency. All other
ordinances pertaining to the powers of the former Zoning Board of
Adjustment, appeals and applications, expiration of variances and
other powers granted by law are hereby saved from repeal and shall
apply to and be followed by the Planning Board.
