The Board of Health shall organize annually on the second Thursday of January of each year, and it shall consist of a minimum of five members and a maximum of seven members, and the Mayor shall be an ex officio member and shall have the right to vote only when one of the members is not present, and at such time it shall elect from its members a President and a Vice-President, who each shall hold office for a term of one year until his/her successor is appointed and qualifies.
The Board of Health shall appoint such officers and employees as the Board may from time to time deem necessary to carry into effect the powers vested in it pursuant to the rules and regulations of the Civil Service Commission (Subtitle 3 of Chapter 11).
The salaries or other forms of compensation of the officers and employees shall be fixed by resolution adopted by a majority (four or more) of all the members of the Board.
Vacancies occurring in any of said offices may be filled temporarily pending civil service certification and pursuant to the rules and regulations of the Civil Service Commission.

Any three members of a five-member Board, and any four members of a six- or seven-member Board shall constitute and be a quorum for the transaction of all of the Board's business. There must be three affirmative votes in a five-member Board and four affirmative votes in a six- or seven-member Board for the following transactions: financial, ordinances and appointments.
A. 
Regular meetings of the Board shall be held on the first Thursday of each and every month at 8:00 p.m.
B. 
Special meetings of the Board may be called at any time by the President or upon the written or oral request of any two members of the Board directed to the President.
The President shall be the chief executive officer, shall preside at all meetings of the Board and shall appoint all committees. In case of the absence, disability or disqualification of the President, the Vice-President shall serve in his place. During the intervals between regular meetings of the Board, the President shall represent and act for the Board in all judicial matters.
The Secretary of the Board shall keep true and accurate minutes of the proceedings of the Board and shall conduct all of the Board's correspondence, keeping proper copies of the same. He shall, as well, discharge all such other duties as may be imposed upon him by the Board (N.J.S.A. 26:3-8.1).
The local Registrar of Vital Statistics shall well and faithfully discharge all duties imposed upon him by law as well as by rules and regulations of the Board (N.J.S.A. 26:8-12).
The Treasurer of the Board shall account for and pay over to the Collector of the Borough of East Rutherford all moneys received by him from fines, licenses and permits, and this Treasurer shall also have other separate and designated duties which shall be approved by the Board from time to time, and he shall be bonded in the amount of $25,000.
All other officers and employees of the Board shall well and faithfully discharge all duties imposed upon them by law as well as by the rules and regulations of the Board.
It shall be lawful for any member of the Board, or its designated representative or any person acting under and by the authority of this Board, to enter in or upon any building, place or premises for any of the purposes specified in this code or for any other purpose in connection with his regular duties, and all persons are hereby forbidden to interfere with or obstruct such inspection, examination or execution.
Whenever any health law or code of this state or any code, ordinances or regulation of the Board shall provide that a notice or notification shall be given by the Board of Health to any person or persons violating the provisions of said law, code, ordinance or regulation, the representative of the Board of Health, as designated by the Board, shall be invested with the power and authority to give such notice in the absence of other notice given by the Board of Health.
This Board shall have the right to revoke any permit or license whenever the holder thereof or any of his servants or agents violate the terms under which the same was issued. Before any license or permit shall be revoked, a notice of the contemplated action of this Board shall be served upon the holder of said permit or license, setting forth such charges as may be the reason for said revocation, and the place, date and hour when said Board will hear the matter. Whenever any licensee shall violate the terms under which said permit or license was issued, this Board or any officer acting under and by authority of the Board shall have the right to suspend the operation of said permit or license pending the hearing.
A. 
All licenses or permits shall be prominently displayed upon the premises for which they were issued, and upon each and every vehicle or device used in the business for which a license or permit is required there shall be displayed at all times in plain sight, upon the side of said vehicle or device, a current sign to be furnished by this Board.
B. 
Every holder of a license or permit shall exhibit the same upon demand to any member of this Board or its designated representative.
