All of the executive, administrative and legislative
powers of the Township of Mullica shall be vested in the Township
Committee.
A.
The Committee shall consist of five members elected
at large from the Township at a general election and shall serve for
a term of three years. The term of each member of the Township Committee
shall begin on January 1 next succeeding the election of the member.
B.
The Township Committee shall hold its annual meeting
on the first day of January, 12:00 noon, or during the first seven
days of January in any year.
C.
At the annual meeting, the Committee shall have the
power and the authority to elect one of their number as Chairman of
the Committee who shall preside at all meetings of the Township Committee
and who shall be known as the "Mayor of the Township." Additionally,
at the annual meeting, the Committee shall have the power and the
authority to elect one of their number as Vice Chairman of the Committee
who shall preside at all meetings in the absence of the Chairman and
who shall be known as the "Deputy Mayor of the Township." The Mayor
and Deputy Mayor shall have no additional authority by virtue of such
designation, except as otherwise provided by law.
B.
The Committee shall hold its regular meetings and
work sessions pursuant to a resolution adopted at each annual reorganization
meeting. This resolution may be amended or modified by subsequent
resolution duly adopted by the Committee.
C.
The Committee may adopt rules of procedure and may,
from time to time, modify such rules of procedure. Such rules may
amplify, but shall not be inconsistent with, the provisions of this
code.
D.
A majority of the Committee shall constitute a quorum
for the transaction of business in accordance with N.J.S.A. 40A:63-3g.
A majority of all members of the Committee shall be required to vote
in the affirmative to pass any ordinance.
E.
The agenda for each regular and special meeting of
the Township Committee shall be prepared by the Clerk. Except for
emergency matters which may be added at any time, the agenda of each
regular meeting of the Committee shall include only such matters of
business as have been presented or delivered to the Clerk not later
than five days preceding the meeting. The Township Committee may,
by majority vote, amend or make additions to any meeting agenda. As
soon as the agenda for each meeting is prepared, the Clerk shall deliver
a copy to each Committee member and to the Township Solicitor.
F.
The Mayor shall preside at all meetings, and in the
absence of the Mayor, the Deputy Mayor shall preside. In addition,
the Mayor shall:
(1)
Preserve order and decorum at all meetings.
(2)
Appoint committees of the Township Committee.
(3)
Sign all ordinances and resolutions adopted by the
Township Committee.
(4)
Rule on all questions of order subject to the approval
of the Township Committee.
(5)
State the question and announce the results of all
matters upon which the Township Committee may vote.
G.
In the absence of the Mayor, the Deputy Mayor shall
exercise all the functions and duties of the Mayor.
H.
The presiding officer may move, second and debate
from the Chair and should not be deprived of any of the rights or
privileges by reason of presiding. The vote of the presiding officer
shall be called last.
I.
The Mayor may call a special meeting of the Township
Committee. If a majority of the members of the Township Committee
make a written request, the Mayor shall call a special meeting. The
request and the call for such special meetings shall specify the purpose
of the meeting, and no other business shall be transacted at the meeting.
In addition to such other powers and duties
as may be conferred upon the Township Committee by this chapter or
by general law, the Township Committee shall have the power to:
A.
Exercise investigative powers by requiring a Township
officer, in its discretion, to prepare and submit sworn statements
regarding his/her official duties and the performances thereof and
otherwise investigate the conduct of any department, office or agency
of Township government and remove by a majority vote of the whole
number of the Township Committee any Township officer other than the
elected members of the Township Committee, for cause, upon notice
and an opportunity to be heard.
B.
Appoint an advisory board of citizens.
C.
Appoint the Township Committee representative to the
Township Planning Board.
D.
Negotiate and approve contracts as necessary.
E.
Approve the Annual Township Budget pursuant to the
Local Budget Law (N.J.S.A. 40A:4-1 et seq.).
F.
Appoint, set salaries and remove any Township officers
and employees subject to the general law and contractual obligations
and the general limits of the Township budget.
G.
Appoint the Township Auditor.
H.
Designate the official newspapers for purposes of
legal advertising of Township affairs.
I.
Exercise any and all general legislative powers conferred
upon the Township Committee by general law.
