It is essential that police, fire and ambulance personnel be able to
locate homes, commercial properties and other buildings without delay to provide
the most effective response to a call for service. The purpose of this chapter
is to provide those emergency personnel in the Town of Brighton with a means
to quickly and accurately identify addresses when responding to such calls
for assistance.
The Fire Marshal, any police officer of the Town of Brighton and the
Commissioner of Public Works or designee are hereby declared to be responsible
for the enforcement of this chapter. A notice of violation may be issued to
the owner of each principal building not in compliance with this chapter.
If the owner of a property does not place said street numbers within
120 days after service of a notice of violation, the Fire Marshal, any police
officer of the Town of Brighton and the Commissioner of Public Works or designee
may issue an appearance ticket directing the owner to appear in Town Court
in connection with the alleged commission of a violation of this chapter.
[Amended 1-24-1996 by L.L.
No. 1-1996]
Any violation of this article shall constitute an offense punishable as provided in Chapter
1, General Provisions. The imposition of one penalty for a violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects at any such time. Each separate offense shall constitute a separate additional violation.
It is hereby declared to be the intent of the Brighton Town Board that:
A. If a court of competent jurisdiction finds any provisions
of this chapter invalid, in whole or in part, the effect of such decision
shall be limited to those provisions which are expressly stated in the decision
to be invalid, and all other provisions of the chapter shall continue to be
separately and fully effective.
B. If a court of competent jurisdiction finds the application
of any provision of this chapter to any building, other structure or tract
or land to be invalid, in whole or in part, the effect of such decisions shall
be limited to the person, property or situation involved in the controversy,
and the application of any such provision to any other person, property or
situation shall not be affected.
