[HISTORY: Adopted by the Board of Trustees of the Village of Bronxville 2-9-1981 as Ch. 55 of the 1981 Code, amended by L.L. No. 6-1983. Subsequent amendments noted where applicable.]
This chapter shall be known and may be cited as the "Fire Prevention Law of the Village of Bronxville, New York."
There is hereby adopted by the Board of Trustees of the Village of Bronxville for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain Code known as the "New York State Uniform Fire Prevention and Building Code," of which Code not fewer than three copies have been and now are filed in the office of the Clerk of the Village and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the Village of Bronxville.
A. 
The New York State Uniform Fire Prevention and Building Code shall be enforced by the Fire Department of the Town of Eastchester.
B. 
The Chief of the Fire Department is permitted to detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department may recommend to the Board of Trustees the employment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and nonmembers of the Fire Department, and appointments made after examination shall be for an indefinite term with removal only for cause.
C. 
The Chief of the Fire Department shall make such periodic reports to the Board of Trustees of the Village as the Board shall from time to time reasonably request and the Chief of the Fire Department shall also recommend any amendments to the Code which, in his or her judgment, shall be desirable.
D. 
The Chief of the Fire Department may request and shall receive so far as may be necessary, in the discharge of his or her duties, the assistance and cooperation of other officials of the village.
E. 
Funds received from the State of New York under § 54-g, State Finance Law, for the purpose of providing support of activities relating to administration, enforcement and inspection as provided in the New York State Uniform Fire Prevention and Building Code may be shared with the Eastchester Fire District in recognition of the inspection services provided by that agency in an amount to be fixed by action of the Board of Trustees on an annual basis or as such funds are received if not on an annual basis.

As used in this chapter, the following terms shall have the meanings indicated:
MUNICIPALITY
Wherever used in the New York State Uniform Fire Prevention and Building Code, it shall be held to mean the "Village of Bronxville."
CORPORATION COUNSEL
Wherever used in the New York State Uniform Fire Prevention and Building Code, it shall be held to mean the "Village Counsel for the Village of Bronxville."
The limits referred to in the New York State Uniform Fire Prevention and Building Code, in which storage of explosives and blasting agents is prohibited, in which manufacture and storage of fireworks are prohibited, in which storage of flammable liquids in outside aboveground tanks is prohibited, in which new bulk plants for flammable or combustible liquids are prohibited and in which bulk storage of liquefied petroleum gas is restricted, are hereby established as the limits of the Village of Bronxville.
The routes for vehicles transporting explosives and blasting agents and for vehicles transporting hazardous chemicals and other dangerous articles shall be established by the Chief of the Fire Department at the time of issuing a permit for such transport.

A. 
Designated fire lanes. The fire lanes in the Village of Bronxville are hereby established as follows:
(1) 
Alden Place - 15 feet on each side of hydrant.
(2) 
Latimer Lane - 15 feet on each side of hydrant No. 120.
(3) 
For a distance of 45 feet in from the corner of Sagamore Road and Beechtree Lane along the south side of Beechtree Lane.
(4) 
For a distance of 30 feet in from the corner of Avon Road and Beverly Road along the west side of Beverly Road.
(5) 
For a distance of 80 feet on the north side of Avon Road at Beverly Road going east toward Sagamore Road.
(6) 
Alden Place - for a distance of 100 feet from the intersection at Midland Avenue on both the east side and west side.
(7) 
Both sides of the entrance road leading from Prescott Avenue to the Gramatan Court Town Houses (located on the tax map as Section 12, Block 4, Lot 1), by posting sign at entrance from Prescott Avenue: "No Parking Along Curbs - Fire Lane."
(8) 
On the outer perimeter of the courtyard at Gramatan Town Houses in front of units numbered 1 to 16 and units numbered 29 and 30, by posting sign at top of entrance drive: "No Parking Along Curbs - Fire Lane."
(9) 
Midland Gardens.
(a) 
For a distance of 240 feet heading north from the corner of Midland Avenue along the east side of the Midland Gardens service road, adjacent to front (west facing facade) of Building #4.
(b) 
For a distance of 71 feet from the northwest corner of Building #4 heading east along the south side of the Midland Gardens service road adjacent to the north side of Building #4.
(c) 
For a distance of 175 feet from the northwest corner of Building #1 heading south along the east side of the Midland Gardens service road adjacent to the west side of Building #1.
(d) 
For a distance of 85 feet from the southeast corner of Building #3 heading south along the west side of the Midland Gardens service road adjacent to the south side of Building #3.
(e) 
For a distance of 123 feet from the southwest corner of Building #2 heading counter clockwise along the circular portion of the Midland Gardens service road adjacent to the front entrance of Building #3.
(10) 
Eastbourne Apartments.
(a) 
For a distance of 140 feet along the northerly property line of Eastbourne Apartments between Stoneleigh Plaza and Lake Avenue.
(b) 
Starting at Lake Avenue on the south connection road between Lake Avenue and Stoneleigh Plaza in a westward direction for a distance of 82 feet, then north along the east curbline of Stoneleigh Plaza for a distance of 196 feet.
(11) 
Stoneleigh Plaza. The parking of vehicles is hereby prohibited on Stoneleigh Plaza:
(a) 
On the west side from the intersection of the north curbline of Pondfield Road West and the west curbline of Stoneleigh Plaza northerly to a point 236 feet northerly therefrom.
(b) 
On the west side from a point in the north line of the driveway leading from the garage of Stoneleigh Apartment northerly along the west side of same and curving to the east and then to the south along the east side of Stoneleigh Plaza for a total distance of 227 feet.
(12) 
Lake Avenue and Rivermere Apartments. The parking of vehicles is hereby prohibited on Lake Avenue as follows:

(a) 
On the east side from a point five feet south of the northerly line of the Lake Avenue apartments extended to a point 19 feet northerly therefrom.
(b) 
Beginning at a point 30 feet southerly from the southeast corner of the Rivermere Apartment building and 23 feet westerly from the Metro North Railroad fence; thence westerly for a distance of 15 feet; thence southerly for a distance of nine feet; thence northeasterly 28 feet to the point of beginning.
(c) 
Beginning at a point in the Metro North/Lake Avenue Owners property line 92 feet eight inches southerly from the southeast corner of the Rivermere Apartment building; thence running in a southerly direction along the property line for a distance of 33 feet.
(13) 
Southgate Apartments. The parking of vehicles is hereby prohibited in the six feet area directly in front of the south extension staircase exit on the connector road between Stoneleigh Plaza and Lake Avenue.
(14) 
Bronxville Elementary School. From the driveway intersection with Midland Avenue at the north end to the driveway intersection with Midland Avenue at the south end including the entire traffic lane closest to the school entrance for a distance of approximately 388 feet.

B. 
Amendments. No fire lanes can be established on private property other than those specifically set forth in this chapter, except by formal amendment of this Section by the Board of Trustees pursuant to proper legal notice, public hearing and other applicable provisions of law.
The Chief of the Fire Department shall have power to modify any of the provisions of the New York State Uniform Fire Prevention and Building Code upon application in writing by the owner or the lessee, or his or her duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of such Code, provided that the intent of such Code shall be observed, public safety secured and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Fire Department thereon shall be entered upon the records of the Department and a signed copy shall be furnished the applicant.
Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the New York State Uniform Fire Prevention and Building Code do not apply or that the true intent and meaning of the New York State Uniform Fire Prevention and Building Code have been misconstrued or wrongly interpreted, in each case with respect to any property located within the Village of Bronxville, the applicant may appeal from the decision of the Chief of the Fire Department to the Board of Trustees of the Village of Bronxville within 30 days from the date of the decision appealed.
The Chief of the Fire Department shall determine and specify after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in the New York State Uniform Fire Prevention and Building Code. The Chief of the Fire Department shall post such list in a conspicuous place in his or her office and distribute copies thereof to interested persons.
A. 
Any person who shall violate any of the provisions of the New York State Uniform Fire Prevention and Building Code hereby adopted or fail to comply therewith, except for violations of § 150-7 hereof, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Board of Trustees of the Village of Bronxville or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a violation, punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or by both such fine and imprisonment. The imposition of a penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time.

B. 
Any person or persons violating § 150-7 hereof or neglecting to comply with any fire or police directive made pursuant to § 150-7 shall be guilty of a violation and, upon conviction thereof, shall be subject to a fine of not more than $25 or imprisonment up to 15 days, or by both such fine and imprisonment for each offense.
C. 
The application of the above penalties shall not be held to prevent the enforced removal of prohibited conditions.
