Pursuant to the provisions of Subdivision 6 of § 130 of the
Town Law, the Town Board of the Town of Wilson has the power to regulate and
control the use of any lands within the Town for use as a dump or dumping
grounds. Pursuant to the provisions of § 119-o of the General Municipal
Law, the Town of Wilson entered into an agreement with the Town of Cambria
for the purpose of purchasing a jointly owned dumping ground within the Town
of Wilson for the use and benefit of the residents of said towns. A parcel
of real property was thereafter purchased jointly by the Towns of Wilson and
Cambria and has since been used for such purpose, and, in addition, the Town
of Newfane has entered into an agreement with said Towns of Wilson and Cambria
for the use of such dump. The agreement pursuant to § 119-o of the
General Municipal Law gives the Town Board of the Town of Wilson the full
authority and power to supervise, control and regulate the operations of said
dump. It is the purpose of this chapter to promulgate rules, regulations and
controls for the operation of said dump and to provide further for the enforcement
of such rules, regulations and controls by the enactment of penalties for
their violation. Further, to better enable the Town of Wilson to control and
supervise the operation of said dump, the position of Dump Administrator under
this chapter is to be established. This position, when filled by an appointment,
will enable the Town to exercise more direct control and supervision of the
dumping operation and procedures at the dump.
The rules, regulations, prohibited acts and procedures established herein
are in addition to any prohibited acts, rules or regulations prescribed by
statute of the State of New York to the extent that the same are more severe
in their application than this chapter.
