No person shall kindle or maintain any bonfire, rubbish fire or any fire of any nature out of doors or authorize such fire to be kindled or maintained in the Borough of Abbottstown, except as provided by § 85-2 herein.
Nothing herein shall prohibit the use of gas grills, charcoal grills, cooking grills and outdoor portable self-contained decorative screened fireplaces and chimneas in the Borough of Abbottstown. Only charcoal, wood, LP and natural gas shall be burnt as fuel. Paper products may be burnt solely to ignite wood products. Any such burning shall be conducted as allowed by federal, state and county regulations.
This chapter shall be enforced by the Fire Chief of the Fire Department designated as first responder for Abbottstown Borough or the Abbottstown Borough Enforcement Officer.
Any person who shall violate the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000, and costs of prosecution, and in default of payment of such fine and costs to a prison term of no more than 30 days.
All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
