A. 
Supervision of the Department. Under the supervision of the Mayor and Council there shall be the following divisions:
(1) 
Division of Construction Code Enforcement.
(2) 
Division of Land Use.
A. 
Division established; supervision. There is hereby established in the Township of Clinton a State Uniform Construction Code Enforcing Agency to be known as the "Division of Construction Code Enforcement" consisting of a Construction Code Official, Building Subcode Official, Electrical Subcode Official, Plumbing Subcode Official, Fire Protection Subcode Official, Elevator Subcode Official, and inspectors as required. Additionally, all other such subcode officials for each subcode adopted by the Commissioner of the Department of Community Affairs, State of New Jersey, are also included. The Construction Code Official shall be the chief administrator of the enforcing agency.
B. 
Powers and duties. Powers and duties of the Division of Construction Code Enforcement shall be as set forth in N.J.A.C. 5:23.
C. 
Qualifications for positions. Each official position created in subsection 10-1.1 hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23; provided that in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.

D. 
Single office location. The public shall have the right to do business with the enforcing agency at one office location except for emergencies and unforeseen or unavoidable circumstances.
A. 
Division established. Within the Department there shall be the Division of Land Use which shall include the Planning Board and the Board of Adjustment.
B. 
Organization; powers and duties of the Planning Board and Board of Adjustment. The organization, powers and duties of the Planning Board and Board of Adjustment shall be as set forth in N.J.S.A. 40:55D-1 et seq.
C. 
Zoning Officer. There is hereby established the office of Zoning Officer who shall be responsible for enforcing the Municipal Land Use Law and the Zoning Ordinances of the Township.[1]

Within the Department there shall be the Division of Zoning which shall include the Zoning Officer and Deputy Zoning Officer and the Zoning Board of Adjustment, except as otherwise provided by law. The Zoning Officer and Deputy Zoning Officer shall be under the supervision of the Construction Code Official. Both the Zoning Officer and Deputy Zoning Officer shall be appointed to annual terms. Any appointments made during the calendar year shall only be for the remainder of that year. The Zoning Board of Adjustment shall be organized and have the powers provided by N.J.S.A. 40:55D-1 et seq., the Municipal Land Use Law.
