The following regulations shall apply in all
R-3 Districts. A precise plan shall be submitted to the Planning and
Zoning Board by the developer for its approval and only after obtaining
approval may the developer proceed with construction of the project.
The purposes of the R-3 District are:
A. To delineate those areas where residential development
has occurred or is likely to occur in multifamily structures in accordance
with the Comprehensive Plan of the City of Lockport.
B. To provide a variety of dwelling unit and structure
types to accommodate the needs of the City's population.
Permitted principal uses in the R-3 District
shall be as follows:
B. Multifamily dwellings or apartment houses.
C. Planned unit development.
G. Rooming houses, tourist homes and boardinghouses.
H. Hospitals and sanitariums.
I. Day-care center.

Permitted accessory uses in the R-3 District
shall be as follows:
A. Any accessory uses permitted in the R-2 Residential
District.
B. Off-street parking areas for the storage of private
vehicles in connection with occupants of multifamily structures.
C. Garage space or parking space for not more than two
motor vehicles for each dwelling unit. For each 2,000 square feet
that the area of the lot exceeds 5,000 square feet, one additional
motor vehicle may be garaged or parked; provided, however, that no
commercial vehicles may be so garaged or parked, except one vehicle,
3/4 ton or less. Space for one motor vehicle, but not including a
commercial vehicle, may be rented to a person not residing on the
same premises.
(1) On all occupied lots, at least one automobile off-street
parking space or garage must be located on the same lot as the dwelling
unit for each car to be domiciled. No required front or side yard
except designated driveway space shall be used for the open-air parking
or storage of motor vehicles, boats, trailers, campers, recreation
vehicles, or parts thereof.
(2) No more than one unlicensed vehicle shall be parked
or stored on a lot in a residential area.
Special uses in the R-3 District shall be as
follows:
A. Any special uses permitted in the R-2 Residential
District.
B. Multifamily structures over three stories or 35 feet
in height.
C. Inside parking of private vehicles where said vehicles
are stored within the principal residential structure.
Other permitted uses and restrictions are as
follows:
A. Building height limit.
(1) One- and two-family residences: three stories, but
not exceeding 35 feet. See Building Code.
(2) Multiple residences, as regulated by State of New
York Multiple Residence Law.
(3) There shall be no height limit for other types of
buildings.
B. Required lot area.
(1) Each lot shall have a minimum of 20,000 square feet
and a minimum width of 70 feet.
(2) Except in multiple residences, where more than one
family is located on a lot, there shall be at least 2,500 square feet
of lot area for each family unit. There shall also be at least 600
square feet of living quarters, exclusive of basement, cellar or storage
space, for each family unit.
C. Percentage of lot coverage. All buildings, including
accessory buildings, shall not cover more than 35% of the area of
the lot.
D. Yards required.
(1) Except as noted below, each lot shall have front,
side and rear yards not less than the following:
(a)
Front yard setback: 30 feet.
(b)
Each side yard setback: 10 feet.
(c)
Rear yard setback: 20 feet.
(2) Exceptions. A detached garage, barn, toolhouse, shed,
workshop or playhouse, for uses incidental to the residential use
of the main building, may be located on the same lot a minimum distance
of five feet to the rear of the foundation wall or any projection
of the main building.
E. Conversions. Any building, residential or otherwise,
existing at the time of adoption of this chapter, being altered in
any manner for occupancy by one or two families, shall provide at
least 600 square feet of living space, exclusive of the basement,
cellar or storage area, for each family unit, and there shall be at
least 1,700 square feet of lot area for each family unit.
