No gasoline filling station shall be established within the City, whether
such station is located on the curb or is what is known as a drive-in station,
without first obtaining the permission of the City Commission.
Application for permission to establish a gasoline filling station shall
be addressed to the City Commission and filed with the City Clerk, and shall
state the location of the proposed filling station and the capacity of the
tank or tanks to be used. Such application shall also state, in detail, the
plans and specifications of the proposed structure to be used in connection
with the filling station, which shall in all respects conform to the building
code and all other ordinances of the City. Such plans and specifications
and the location of the filling station shall be subject to the approval of
the City Commission, and such approval shall be withheld by the Commission,
and no permission shall be granted, if, in the opinion of the Commission,
it shall appear that the filling station would be dangerous or detrimental
to the public welfare and safety, because of traffic congestion or conditions,
or otherwise unsafe because of its proximity to any school, church, theater
or other place of public assembly, or in any location where, by reason of
traffic conditions or fire or explosion hazard, a filling station would imperil
the public safety. No such permission shall be granted for a filling station
in any location where the same would be restricted or prohibited under the
provisions of the Zoning Ordinance, nor shall such permission be granted for filling stations at the
curb or located in the public streets or alleys of the City.
The City Commission may prescribe reasonable conditions under which
any permission shall be granted for the establishment of a gasoline filling
station. In case such conditions are imposed by the Commission, the person
requesting permission shall, before such permission is granted, sign and execute
an agreement, to be filed with the City Clerk, agreeing to abide by and comply
with all such conditions.
No advertising signs constructed of wood or any flammable material or
of such dimensions as to obstruct the view of traffic, or which shall in any
way hinder access to such station, from all directions, by the Department
of Public Safety, shall be constructed or allowed to exist on any premises
used as a gasoline filling station.
