All roads or driveways abutting or connecting to Town
roads shall have a culvert with a minimum diameter of 12 inches which extends
on each end three feet wider than the road or driveway, except where the Town
Board determines a culvert is not necessary for drainage. Permits are required.
Sidewalks to be kept clear. The owner or occupant of
any public or private property, buildings, schools, churches, hospitals, businesses
or vacant lots adjacent to a sidewalk shall keep snow, ice and debris free
and clear from the sidewalks for the safety, health and general welfare of
the public. When ice is formed on the sidewalk so that it cannot be removed,
it shall be kept sprinkled with ashes, salt, sand or like material.[1]
Deposit on rights-of-way prohibited. No person shall
deposit, by any means, snow and ice from private property onto any public
streets, sidewalk, parking lot, alley or any other type of public right-of-way.
All existing sidewalks shall be kept clear of ice, snow and debris, regardless
of condition, width or location.
Location. All utility and service lines, including but
not limited to sewer, water, electric, telephone, and cable television, when
buried within the Town road right-of-way shall be buried within the outermost
five feet of the Town road right-of-way.
Variances. If installation of such utility line at the location set forth in Subsection A requires the removal of substantial tree coverage, so as to cause an adverse environmental impact, any person may petition the Town Board to install or construct a utility line other than on the outermost five feet of the Town road right-of-way. Upon such petition, the Town Board shall view the premises and, if it finds that such adverse environmental impact would in fact occur, may permit the installation of the utility line at a different location as determined by the Town Board.
Permit. No such service or utility lines, including but
not limited to sewer, water, electric, telephone and cable television, may
be buried or otherwise installed within the Town road right-of-way without
first receiving a permit therefor from the Town Board. Application for such
permit shall be made to the Town Clerk/Treasurer.
Except as otherwise provided, any person found to be in violation of any provision of this chapter shall be subject to a penalty as provided in Chapter 1, § 1-4 of this Code.
