A. 
General. Elected officials of the City shall consist of the following.
(1) 
Mayor. The Mayor, by virtue of the office of Mayor, is a member of the Common Council.
(2) 
Aldermen. Six Aldermen consisting of two Aldermen elected from each Aldermanic District.
(3) 
Municipal Judge. A Municipal Judge to officiate over judicial matters of the municipality.
B. 
Terms.
(1) 
Mayor. The Mayor shall be elected for a term of two years at the regular City election. The Mayor's term shall commence on the third Tuesday of April in the year of the election.
(2) 
Alderman. Aldermen shall be divided into two classes consisting of no more than three Aldermen in each class. Each class shall consist of no more then one Alderman from each Aldermanic District. An Alderman shall be elected to a term of two years from the ward in which he/she is a resident at the regular municipal election. Whenever it is necessary to alter Aldermanic Districts for the purposes set forth in § 62.08, Wis. Stats., the Council may provide a different tenure for the office of Alderman. Aldermanic terms of office shall commence on the third Tuesday of April in the year of the election.
(3) 
Municipal Judge. The Municipal Judge shall be elected to a four-year term. The term of the Judge shall commence on May 1 of the year of the election.

Unless otherwise provided by law, Mayoral appointments of citizens and Alderpersons to standing committees, City boards and commissions shall, regardless of any time remaining on the appointment, expire six months after the appointing Mayor leaves office. This provision shall apply to the following boards and commissions:

A. 
"Residency" defined. The term, as used in this section, shall be construed to mean actual living quarters. Neither voter registration, ownership of real property nor paying taxes of any kind by an employee within the territory encompassed by the residency requirement, by themselves or together, shall be deemed adequate to satisfy this section. The maintaining of a rented room or rooms within the territory encompassed by the residency requirement, when not coupled with the employee's actual living quarters, shall be deemed insufficient to meet the requirements of this section.
B. 
Residency required. All nonseasonal municipal employees working more than 30 hours per week shall be required to live within a ten-mile radius of Oconto Falls City Hall. Residency shall be required of all new nonseasonal employees working more than 30 hours per week within 12 months of employment.

C. 
Notification. All municipal employees shall keep the City Administrator - Clerk/Treasurer up-to-date with their current street and mailing address and phone number. Any changes in address or phone number shall be reported to the City Administrator - Clerk/Treasurer within seven days of the date the change occurred.
D. 
Review of violations. The Personnel Committee is hereby authorized to investigate all complaints made to the City with respect to the residency of municipal employees and may initiate any such investigation on its own motion.
E. 
Violations. After completing its investigation on the status of an employee's residency, upon finding a violation of this section, the Personnel Committee shall recommend suspension or termination of the employee to the Common Council, whose decision shall be final.

Whenever the Assessor, in the performance of the Assessor's duties, requests or obtains income and expense information pursuant to § 70.47(7)(af), Wis. Stats., or any successor statute thereto, then such income and expense information that is provided to the Assessor shall be held by the Assessor on a confidential basis, except, however, that the information may be revealed to and used by persons in the discharge of duties imposed by law; in the discharge of duties imposed by office (including but not limited to use by the Assessor in performance of official duties of the Assessor's office and use by the Board of Review in performance of its official duties); or pursuant to order of a court. Income and expense information provided to the Assessor under § 70.47(7)(af), Wis. Stats., unless a court determines that it is inaccurate, is, per § 70.47(7)(af), Wis. Stats., not subject to the right of inspection and copying under § 19.35(1), Wis. Stats.

Pursuant to the authority granted to the Common Council in § 62.09(1), Wis. Stats., to provide "other officers" for the City, there is hereby created for the City of Oconto Falls the position of City Administrator.
A. 
The City of Oconto Falls, pursuant to § 62.09(3)(c), Wis. Stats., hereby combines the existing Clerk/Treasurer office and the office of City Administrator into the office of City Administrator - Clerk/Treasurer (hereinafter "Administrator").
B. 
All references in the existing City of Oconto Falls ordinances to "Clerk/Treasurer" shall mean the Administrator.
The City of Oconto Falls, pursuant to the authority granted by and in § 66.0101(4), Wis. Stats, hereby elects not to be governed by those portions of Ch. 62, Wis. Stats., which are in conflict with this article.
A. 
The City Administrator shall be appointed by the Common Council by means of the following procedure:
(1) 
Two qualified candidates for the position shall be proposed by the Personnel Committee.
(2) 
The Mayor shall nominate one of the two candidates to the Council.
(3) 
The Common Council shall vote on the nominee, and if the nominee receives the affirmative vote of at least 2/3 of all members of the Common Council, he or she shall be appointed to the position.
B. 
The Administrator shall be selected on the basis of merit with due regard to education, training, experience, administrative ability and general fitness for the office. The Administrator shall hold office for an indefinite term subject to termination as provided in this article.

The employment agreement negotiated by the City and the Administrator shall provide for termination of the agreement.
The salary and other benefits payable to the Administrator shall be established, from time to time, by separate ordinance, resolution and/or written contract.

The City Administrator shall be subject to the residency requirement set forth at § 100-5 of the Code of the City of Oconto Falls.

Subject to the limitations and responsibilities imposed, from time to time, by Wisconsin Statutes and the resolutions and ordinances of the City, the Administrator shall be the chief administrative officer of the City, responsible only to the Mayor and Common Council for the proper administration of the business affairs of the City, and shall have the following duties and powers:
A. 
General duties. The Administrator shall:
(1) 
Carry out directives of the Common Council and the Mayor which require administrative implementation, reporting promptly to the Mayor and Common Council regarding the results obtained and any difficulties encountered;
(2) 
Be responsible for the administration of all day-to-day operations of City government, including the monitoring of City compliance with state statutes and regulations and City ordinances and resolutions;
(3) 
Be responsible for the preparation, recording, organization and safe keeping of all City ordinances, resolutions and minutes and the resolutions and minutes of each City committee, commission and board and all other documents and records required by law, ordinance or resolution relating to the property and/or activities of the City;
(4) 
Establish, where and when necessary, administrative procedures to increase the effectiveness and efficiency of City government according to current practices of government and consistent with the directives of the Common Council;
(5) 
Serve as an ex officio, nonvoting member of all boards, commissions and committees of the City, except as otherwise specified by the Common Council, this Code or state law;
(6) 
Keep informed concerning current federal, state and county legislation and administrative rules affecting the City and submit appropriate reports and recommendations thereon to the Common Council;
(7) 
Keep informed concerning the availability of federal, state and county funds for local programs and submit appropriate reports and recommendations thereon to the Common Council, in a timely manner, and assist, when directed by the Common Council, in the obtaining of such funds;
(8) 
Represent the City in matters involving legislative and intergovernmental affairs when authorized and directed by the Common Council;
(9) 
Act as public information officer for the City, with the responsibility of assuring that all open meeting rules and regulations are followed;
(10) 
Establish and maintain procedures to facilitate communication between citizens and their City government to assure that complaints, grievances, recommendations and other matters receive prompt attention by the responsible official or department and to assure that all such matters are expeditiously resolved;
(11) 
Work with the Community Development Authority (CDA) to promote the economic well-being and growth of the City;
(12) 
Attend all meetings of the Common Council, unless excused by the Mayor or majority vote of the Common Council, and at such meetings be prepared to answer questions and provide information regarding City affairs to assist the Mayor and members of the Council in the performance of their duties;
(13) 
In coordination with the Mayor and Common Council, prepare agendas for all meetings of the Common Council and all committees, commissions and boards, together with such supporting materials as may be required or helpful; provided, however, that nothing herein shall be construed to give the Administrator any authority to limit or prevent matters or issues from being considered by the Common Council or any committee, commission or board;
(14) 
Inform the Mayor and Common Council of any ordinances, resolutions, documents, committee appointments or other matters requiring action;
(15) 
Assist the City Attorney in the preparation of ordinances and resolutions when needed or when requested by the Mayor or Common Council;
(16) 
Keep the Mayor and Common Council regularly informed about the activities of the Administrator's office, by oral or written report, upon request by the Mayor and/or the Common Council;
(17) 
Receive directives from the Mayor in the event that action normally requiring Common Council approval is necessary at a time when the Common Council cannot meet; and
(18) 
In the absence of the Mayor and the President of the Common Council, call and/or preside over meetings of the Common Council.
B. 
Clerk/Treasurer duties. The Administrator shall:
(1) 
Carry out the duties and responsibilities of Clerk and Treasurer set forth in the Wisconsin Statutes, Wisconsin Administrative Code, City ordinances, and such instruction as may be issued by the Common Council; and
(2) 
Subject to approval of the Common Council, appoint persons to serve in the capacity of Deputy Clerk and Deputy Treasurer under the Administrator's supervision.
C. 
Personnel duties. The Administrator shall:
(1) 
Be responsible for the administration, direction and coordination of all employees and nonelected officers of the City according to such procedures as may be established by the Common Council;
(2) 
Assist in the appointment and/or hiring of all nonelected officers and employees. When a vacancy occurs, the Administrator shall take such steps as are necessary to solicit or advertise for applicants for the vacant position. The Administrator shall review the applications according to established hiring procedures and, upon completion of such review, shall submit to the Personnel Committee a ranked list of applicants with an evaluation of each applicant. The list shall consist of five candidates, unless there are fewer than five applicants for the position and then the list shall consist of all of the applicants. A selection shall be made by the Personnel Committee, which shall refer it to the Common Council for final action;
(3) 
Serve as personnel officer for the City with responsibility to see that complete and current personnel records, including specific job descriptions, are kept for all nonelected City officers and employees; to recommend salary and wage scales for City employees not covered by collective bargaining agreements; to develop and enforce high standards of performance by nonelected officers and employees; to assure that nonelected officers and employees have proper working conditions; and to work closely with department heads to resolve promptly personnel problems and grievances;
(4) 
Keep the Personnel Committee regularly informed about personnel matters and carry out the directives of the Personnel Committee concerning personnel matters;
(5) 
Evaluate, in conjunction with department heads, the performance of employees on a regular basis and recommend to the Personnel Committee the promotion and, when necessary, the reprimanding, suspension or termination of any employees;
(6) 
Evaluate, annually and in writing, in conjunction with the Personnel Committee, the performance of all department heads and nonelected officers and recommend to the Common Council the promotion and, when necessary, the reprimanding, suspension or termination of any department head or nonelected officer;
(7) 
Assist in labor contract negotiations and collective bargaining issues; and
(8) 
Work closely with department heads to assure that employees receive adequate training to maintain and improve their job skills and act as the approving authority for conferences, meetings, training, schools, etc., provided that funds have been budgeted for these activities.
D. 
Budgeting and purchasing duties. The Administrator shall:
(1) 
Be responsible for preparation of the annual City budget, in accordance with such guidelines as may be provided by the Common Council, in coordination with department heads and pursuant to state law, for final review and approval by the Common Council;
(2) 
Administer the budget as adopted by the Common Council;
(3) 
Report regularly to the Mayor and Common Council on the current fiscal position of the City;
(4) 
Supervise the accounting system of the City and ensure that the system employs methods in accordance with current professional accounting practices and standards; and
(5) 
Supervise the purchasing of all materials, supplies and equipment for which funds are provided in the budget; contract for items necessary for the operation and maintenance of City services for amounts up to $10,000; and receive bids or proposals for purchases or contracts in excess of $10,000 for presentation to the Common Council for approval, unless taking bids or the prior approval requirement is waived by a vote of the Council.
E. 
Additional contractual obligations. Nothing herein shall preclude or limit the City and Administrator from establishing, by written contract, other employment terms and conditions not inconsistent herewith.
Pursuant to § 66.0101(3) and (5), Wis. Stats., this article shall be published in the Oconto County Times-Herald on May 2, 2002, as a Class 1 notice and shall take effect 60 days from the date of publication.
