As used in this article, the following terms shall have the meanings
indicated:
FERMENTED MALT BEVERAGE
Any liquid capable of being used for beverage purposes made by the
alcoholic fermentation of an infusion in potable water of barley malt and
hops, with or without unmalted grains or degerminated grains or sugar, containing 1/2
of 1% of alcohol or more by volume.
INTOXICATING LIQUOR
All distilled or vinous liquors containing 1/2 of 1% of alcohol
or more by volume.
OPEN CONTAINER
Any device capable of holding or storing a liquid which does not
possess an unbroken seal or permanently affixed cover.
No person shall consume any intoxicating liquor or fermented malt beverage
while in a vehicle parked on a public highway or in any public parking lot.
No person shall possess or permit to be possessed in any moving or parked
vehicle under his control any open container of intoxicating liquor or fermented
malt beverage.
Any person who shall violate any provision of this article shall, upon
conviction thereof, forfeit not more than $100 together with costs of prosecution
and, in default of payment of that sum, shall be imprisoned in the county
jail until said forfeiture and costs are paid, but not to exceed 30 days.
