This chapter is adopted pursuant to authority granted by §§ 61.34,
61.345, and 287.09, Wis. Stats.
It is hereby declared to be the purpose and intent of this chapter
to enhance and improve the environment and promote the health, safety,
and welfare of the residents of the Village by establishing minimum
standards for the storage, collection, transport, processing, separation,
recovery and disposal of solid waste.
This chapter shall be known and referred to as the "Solid Waste and Recycling Collection Ordinance of the Village of Wrightstown" or as Chapter 165 of the Village of Wrightstown Municipal Code.
The provisions of this chapter shall be interpreted to be minimum requirements and shall be liberally construed in favor of the Village. Headings provided in this chapter are for convenience and ease of reference; they shall not be interpreted to limit the applicability, purpose, effect or meaning of any of the provisions of this chapter. Any word or phrase defined in § 165-6 of this chapter shall have the meaning stated therein. Undefined words or phrases shall have their common, ordinary meaning unless some other meaning is clearly suggested by the context in which a particular word or phrase appears. As used in this chapter, "shall" is mandatory and "may" is permissive.
The provisions of this chapter shall be administered by the
Director of Public Works and the Village Administrator.
The following words or phrases, as used in this chapter, shall
have the meanings set out below:
A container for carbonated or malt beverages that is made
primarily of a combination of steel and aluminum.
Trimmings from shrubs and trees, tree limbs less than four
inches in diameter, and stalks from garden plants. Brush does not
include stumps, root balls, or logs greater than four inches in diameter.
Classified as any item too large to fit into the collection
cart when permitted.
Collectible recyclables shall include aluminum containers,
corrugated paper and other container board, glass containers, magazines,
newspaper, office paper, rigid plastic containers, including those
made of PETE and HDPE, steel containers, and bimetal containers. The
items listed as collectible recyclables in this subsection may be
modified by the Director of Public Works in accordance with the effective
date of Wisconsin law or applicable Wisconsin Department of Natural
Resources regulations or variances therefrom. The Director of Public
Works shall be responsible for informing the public of all acceptable
collectible recyclables.
The act of removing solid waste or recyclable materials from
the storage area at the source of generation.
All solid waste that is subject to collection by the Village-authorized
contractor by contract and does not include yard waste, recyclable
materials, special haul items and materials defined as uncollectible
wastes.
The person or persons specifically authorized by the Village
Board to collect garbage, refuse and recyclable materials and dispose
of the same.
Waste resulting from the operation of business enterprises,
including, but not limited to, offices, stores, taverns, service stations,
restaurants, and similar businesses, excluding hazardous, toxic, noxious
or offensive waste, brush, yard waste, refuse, or commercial debris.
Corrugated paperboard used in the manufacture of shipping
containers and related products. This does not include waxed cardboard.
That portion of solid wastes consisting of wastes from the
construction, repair, remodeling or reconstruction of buildings, such
as lumber, roofing and sheathing scraps, rubble, broken concrete,
asphalt and plaster, conduit, pipe, wire, insulation and any other
materials resulting from the demolition of buildings and improvements.
The orderly process of discarding useless or unwanted material.
packaging made primarily from foam polystyrene that satisfies
one of the following criteria:
Any waste accumulation of animal, fruit or vegetable matter,
liquid or solid, that attends the preparation, use, cooking, dealing
in or storing of meat, fish, fowl, fruit or vegetables, including
that from houses, butcher shops and similar establishments and including
in both cases natural content of moisture. Any combination of garbage
and refuse shall always be deemed to be garbage for the purpose of
licensing under this section.
Any radioactive, volatile, highly flammable, explosive, toxic
or hazardous materials. Hazardous materials shall include, but not
be limited to, any amount of waste listed or characterized hazardous
by the United States Environmental Protection Agency or any state
agency pursuant to the Resource Conservation and Recovery Act of 1976,[1] as amended, and applicable state law.
High-density polyethylene, labeled by the SPI code #2.
Waste material, except garbage and refuse, directly or indirectly
resulting from an industrial processing or manufacturing operation.
Solid waste that contains pathogens with sufficient virulence
and in sufficient quantity that exposure of a susceptible human or
animal to the solid waste could cause the human or animal to contract
an infectious disease.
Low-density polyethylene, labeled by the SPI code #4.
Any magazine or other materials printed on similar paper.
A residential or commercial air conditioner, clothes dryer,
clothes washer, dishwasher, freezer, microwave oven, oven, refrigerator,
furnace, boiler, dehumidifier, water heater or stove.
Waste resulting from manufacturing processes or operations,
excluding hazardous, offensive, toxic or noxious wastes, refuse, yard
waste, brush, and construction debris.
any container, package or material that contains infectious
waste or that is from a treatment area and is mixed with infectious
waste.
A property containing more than four residential units, including
those which are occupied seasonally.
A newspaper and other materials printed on newsprint.
Include any commercial, retail, industrial, institutional
and governmental facilities and properties. This term does not include
multifamily dwellings.
Solid waste from agricultural, commercial, governmental,
industrial or institutional activities.
Those wastes that are unwholesome, have an unpleasant smell,
or are otherwise noxious and/or offensive, such as manure, filth,
slop, carcasses, carrion meat, fish, entrails, hides and hide scrapings,
paint, kerosene, oil or greasy substances, and objects that may cause
injury to any person or animal, or damage to vehicles, such as barbed
wire, briar thorns, and similar materials.
High-grade printing and writing papers from offices in nonresidential
facilities and properties. Printed white ledger and computer printout
are examples of office paper generally accepted as high-grade. This
term does not include industrial process waste.
Plastic resins labeled by the SPI code #7.
Any individual, corporation, partnership, association, local
governmental unit as defined in § 287.01(5m), Wis. Stats.,
state agency or authority, or federal agency.
Polyethylene terephthalate, labeled by the SPI code #1.
An individual, separate, rigid plastic bottle, can, jar or
carton, except a blister pack, that is originally used to contain
a product that is the subject of a retail sale.
Any solid waste other than solid waste generated in the production
of goods, hazardous waste as defined in § 291.01(7), Wis.
Stats., demolition/construction wastes, scrap automobiles, or high-volume
industrial waste, as defined in § 289.01(17), Wis. Stats.
Polypropylene, labeled by the SPI code #5.
Collection services provided by a person licensed to do so
by the D.N.R.
Polystyrene, labeled by the SPI code #6.
Polyvinyl chloride, labeled by the SPI code #3.
A container authorized and provided by the Village for use
in the collection of recyclable materials from residential properties.
Include lead-acid batteries, major appliances, waste oil,
yard waste, and collectible recyclables.
Miscellaneous waste material of such size as is not normally
collected with garbage, including but not limited to major appliances,
furniture, plumbing fixtures, and logs greater than four inches in
diameter.
All solid waste that normally originates in a residential
environment from residential dwelling units.
To remove materials placed for collection by one other than
a licensed collector at any point in solid waste disposal process.
Any needle or other device used for the administering and/or
transfer of any medicine, drug, solution or substance for the medical
treatment of any disease or condition of any human or animal; and
any scalpel, knife, tool or appliance used for the treatment, correction
or modification of any disease, condition or physical state of any
human or animal; where exposure to such thing in an uncontained or
unprotected state could subject a human or animal to a needle stick,
cut, laceration or other type wound, or to contact with any blood
or other bodily fluid of another, or any bacteria, virus, or any other
infectious, toxic or hazardous substance.
A red container for sharps, of a type of construction that
will reasonably resist penetration of sharps, and which has been generally
approved for such a medical use; and which is labeled as containing
sharps and, if appropriate, infectious waste and/or biohazard substances.
Garbage, refuse and other useless, unwanted or discarded
material, except recyclable materials, from agricultural, residential,
commercial, industrial or institutional activities. Solid waste does
not include solid or dissolved material in domestic sewage.
Any method, technique or process which is designed to change
the physical, chemical or biological character or composition of solid
waste. "Treatment" includes incineration.
Include body waste, dead animals, large vehicle parts, large
equipment, large appliances, large discarded furniture and bulky construction/demolition
waste; shall be considered items subject to special haul services
and charges and are not considered residential waste subject to regular
weekly collection.
The interim containment of solid waste in an approved manner
after generation and prior to collection and ultimate disposal.
Areas where persons place carts during noncollection days
as well as areas where containers are set out on collection day.
A container authorized and provided by the Village for use
in the collection of garbage, refuse and other collectible solid waste
from residential properties.
A tire that is no longer suitable for its original purpose
because of wear, damage or defect.
The Wisconsin Department of Natural Resources.
All materials originating in the yard and garden which are
capable of natural decomposition, including leaves, grass clippings
and other vegetation, exclusive of: brush as described herein, stumps,
root balls, and logs greater than four inches in diameter.

A.
Residential source. Normal accumulation of garbage from a residential
source shall be collected by the Village once each week. Normal accumulations
of recyclables from residential sources shall be collected once every
two weeks. The maximum combined volume of the garbage and collectible
recyclables placed for collection on one day shall be 190 gallons
from each residential unit that contains not more than four residential
dwelling units.
B.
Multifamily source. Garbage and collectible recyclables shall not
be collected from any multifamily source greater than four dwelling
units. All owners or designated agents of multifamily dwellings shall
be responsible for the property and sanitary transportation of garbage
and collectible recyclables generated from multifamily sources in
compliance with all federal, state and local laws and regulations.
C.
Commercial or manufacturing sources. Normal accumulations of garbage
from commercial or manufacturing concerns shall be collected once
each week. Normal accumulations of collectible recyclables shall be
collected from a commercial or manufacturing source once every two
weeks. The maximum combined volume of the garbage and collectible
recyclables placed for collection on one day shall be 190 gallons
from each commercial or manufacturing concern.
D.
Other sources. Normal accumulations of garbage from other nonprofit
or governmental buildings shall be collected once each week. Collectible
recyclables from nonprofit and governmental buildings shall be collected
once every two weeks. The maximum combined volume of the garbage and
collectible recyclables placed for collection on one day shall be
190 gallons from each nonprofit or governmental building.
E.
Construction debris. Construction debris shall not be picked up by
the Village's contracted collector. It shall be the responsibility
of the owner and/or contractor to dispose of construction debris as
provided by law.
F.
Brush. As provided in § 165-10A, all residential brush will be chipped at the curb every other week, consistent with the collectible recyclables schedule, April through November.
G.
Yard waste. Yard waste shall not be disposed of with garbage or collectible
recyclables during weekly collection. Village residents transporting
yard waste to the compost site shall be responsible to cover or otherwise
contain yard waste in a manner so as to prevent scattering or dumping
of yard waste in transport.
A.
Owner/occupant storage responsibility. The owner and/or occupant
of a premises shall be responsible for the proper and sanitary storage
of all collectible solid waste accumulated at the premises until collection.
The owner and/or occupant shall be responsible for the proper sanitary
storage of all other solid waste material, and for its disposal according
to law.
B.
Storage of collectible solid waste. No owner or occupant of any building
shall place or store any refuse cart or recycling cart in front of
any building, or on any corner lot along the side of a building facing
the abutting street, except when done for lawful collection in compliance
with this Code.
A.
Location of cart for collection.
(1)
Residential. Residential garbage and collectible recyclables from
buildings containing not more than four residential dwelling units
will be prepared and placed for collection. Placement location: containers
shall be placed on the driveway apron or on the grassy area immediately
adjacent to the curb. Containers shall be placed with the opening
facing the street or curb.
(2)
Multifamily. Residential garbage and collectible recyclables from
buildings containing not more than four residential dwelling units
will be prepared and placed for collection. Placement location: containers
shall be placed on the driveway apron or on the grassy area immediately
adjacent to the curb. Containers shall be placed with the opening
facing the street or curb.
(3)
Location of carts in winter. During winter months, garbage and/or
collectible recyclable carts shall be placed in the driveway apron
or on an area adjacent to the curbline, which has been shoveled free
of snow. Carts shall not be placed on top of snowbanks, in the gutter
or street.
B.
Placement of garbage for collection generally (carts). All garbage placed curbside for collection shall be in carts approved of under this section. Carts not approved by the Village shall not be placed for collection and shall not be emptied by the Village's contractor. Carts are provided for a fee as listed in Chapter 102, Fees and Penalties.
(1)
Residential garbage. Residential garbage must be placed in the cart
provided. Before placing any garbage in the cart for collection, each
patron shall first wrap it in paper or secure in a plastic garbage
bag. It shall be the responsibility of each patron to keep the garbage
relatively free from rainwater and snow until collection.
(2)
Commercial and manufacturing garbage. Commercial and manufacturing
garbage shall be placed in a cart. Before placing any garbage in the
cart for collection, each patron shall first wrap it in paper or secure
in a plastic garbage bag. It shall be the responsibility of each patron
to keep the garbage relatively free from rainwater and snow until
collection.
(3)
Enclosures (commercial and multifamily). Exterior storage areas for
garbage, recyclables, and refuse shall be enclosed in a three-sided
structure constructed of materials sufficiently opaque to ensure that
the waste is impervious to view from the exterior of the sides. Plastic
or wooden slats through cyclone fencing shall not be deemed sufficient.
The walls of the structure shall be of a height which is at least
one foot taller than the garbage or refuse receptacle, but not over
six feet high, and shall be painted or otherwise finished or coated.
C.
Collection of recyclables. Collectible recyclables shall be separated from garbage and other collectible solid waste and placed for collection in conformity with this Subsection C. Any violations of this section are subject to fees and penalties as listed in Chapter 102, Fees and Penalties.
(1)
Residential collectible recyclables. Occupants of residences containing not more than four dwelling units and occupants of condominiums shall separate collectible recyclables from garbage and other solid waste, and shall keep the collectible recyclables clean and free of contaminants, oil, grease, and other nonrecyclable materials, including but not limited to household hazardous waste, medical waste, and agricultural chemical containers. Recyclable materials shall be stored in carts provided by the Village and shall be placed curbside for collection as provided in Subsection A above.
(2)
Multifamily dwellings and nonresidential facilities and properties.
(a)
Owners or designated agents of multifamily dwellings, and of
nonresidential facilities and properties, shall be responsible to:

Provide adequate separate containers for recyclable materials;
[2]
Notify tenants in writing at the time of renting or leasing
the dwelling or facility, and at least semiannually thereafter, about
the established recycling programs;
[3]
Provide for the collection of materials separated from the solid
waste, and the delivery of the materials to a recycling material facility;
[4]
Notify tenants of the reasons to reduce and recycle solid waste,
which materials will be collected, how to prepare the materials in
order to meet the processing requirements, the collection methods
or sites, the locations and hours of operation, and a contact person
or company, including the name, address, and telephone number.
(b)
The requirements of Subsection C(2)(a)[1], [2], [3] and [4], above, will not apply to the owners or designated agents of multifamily dwellings if the post-consumer waste generated within the dwelling is treated at a processing facility licensed by the Department of Natural Resources, and is a facility which recovers collectible recyclables from solid waste in as pure a form as is technically feasible.
(3)
Collection time. All garbage, collectible recyclables, and other
collectible solid waste shall be placed for collection as required
by this chapter by 6:30 a.m. on the designated collection day.
(4)
Preparation time. All garbage, collectible recyclables, and other
collectible solid waste, when placed in front of a property pursuant
to this chapter, shall not be so placed prior to 6:30 p.m. the day
before the collection day. Any garbage cart, recyclables cart, solid
waste, or other item which is not collected in accordance with applicable
provisions of this chapter shall be removed from the curbside not
later than midnight the day of collection.
A.
Brush. For residential only, the Public Works Department will chip
brush, tree branches, shrubs, and woody vines (excluding boards, posts,
lumber, beams or other fragments) less than four inches in diameter
at the resident curb site on a schedule during April to November as
set from time to time by the Director of Public Works. In the event
of severe wind, hail, or thunderstorms, chipping of downed tree limbs
or branches may proceed on a more frequent basis.
(1)
Brush chipped at the curb shall be neatly placed with cut ends facing
the street. Brush shall not obstruct the street, gutter, or sidewalk.
The brush pile shall be limited to less than four feet in height and
25 feet in length. Brush piles that exceed four feet by 25 feet will
be subject to charges invoiced at the current rate for labor and equipment.
Charges will be invoiced in fifteen-minute increments, with a half-hour
minimum charge.
(2)
Brush cut by contractors will not be chipped by the Village.
B.
Christmas trees. Christmas trees shall be recycled during a four-week
curbside pickup schedule. Trees will be collected each week by DPW
staff, consistent with the curbside solid waste and recyclable collection
program. All Christmas trees are to be free of bags, wires and stands.
C.
Yard waste. Village residents may dispose of yard waste at the Village
compost site. The following rules apply.
(1)
Site access is restricted to Village of Wrightstown residents only.
(2)
Contractors or hired landscapers are not authorized access to the
site.
(3)
Accepted materials include grass, leaves, plant and garden waste.
(4)
Items not accepted are brush, sod, dirt, root balls, tree stumps,
stone, cement, bricks, plastic bags, paper yard waste bags, or any
other material. Questions are to be referred to the Public Works Department.
(5)
Finished compost is available to Village of Wrightstown residents
only. Contractors or landscapers are not authorized to take finished
compost.
(6)
The use of gas- or diesel-powered equipment is prohibited by residents.
(7)
Hours of operation are to be determined from time to time by the
Director of Public Works or as approved by the Village Board.
A.
Electronics. Since September 1, 2010, Wisconsin's recycling law prohibits disposal of certain electronic devices in Wisconsin landfills, burning in an incineration facility, or placing these devices in a container intended for disposal or incineration. This prohibition is placed on any person, business or entity in the State of Wisconsin. All persons in the Village shall separate the following electronic devices from their post-consumer waste and recycle with an authorized or licensed collector (drop-off fees apply at the Wastewater Treatment Plant, as listed in Chapter 102, Fees and Penalties):
(1)
Televisions.
(2)
Monitors.
(3)
Video display devices.
(4)
Computers, laptop and desktop.
(5)
Computer peripherals such as keyboards, mice, speakers, hard drives,
etc.
(6)
Printers, copiers, and fax machines.
(7)
DVD players, VCRs, DVRs, camcorders, and other video players.
(8)
Telephones, cell phones and phones with video display.
(9)
Stereo components.
The owner and/or occupant of any premises shall be responsible for the proper disposal of lead batteries, waste oil, and used tires as follows (drop-off fees apply at the Wastewater Treatment Plant, as listed in Chapter 102, Fees and Penalties):
A.
Lead-acid batteries and other recyclable batteries shall be taken
to a retailer or other licensed collector for proper disposal.
B.
Major appliances shall be disposed of at an authorized collector
at the owner's expense.
C.
Waste oil and other solvents shall not be placed in the automated
trash or recycling carts. Waste oil and other solvents shall be taken
to an authorized collection site.
D.
Waste tires shall be returned to a tire retailer or to an authorized
collection site.
E.
CFLs, (compact fluorescent light bulbs) should safely be recycled
because they contain mercury. CFLs can be taken to the Brown County
Household Hazardous Waste Facility or any other authorized collector.
A.
Items (shown below) that do not fit in or are not authorized to be placed in the solid waste or recyclable collection cart may be brought to a licensed collector, the Brown County Solid Waste Transfer Station, the Brown County Household Hazardous Waste Facility, or the Village of Wrightstown Wastewater Treatment Plant (drop-off fees apply at the Wastewater Treatment Plant, as listed in Chapter 102, Fees and Penalties):
(1)
Items that contain Freon such as a refrigerator, dehumidifier, freezer,
etc.
(2)
Appliances such as a stove, washer, dryer, dishwasher, water heater,
etc.
(3)
Scrap metal or aluminum-type items.
(4)
Large garbage items such as couches, carpet, cabinets, etc.
(5)
All electronics and tires.
(6)
Batteries, waste oil, and fluorescent light bulbs, currently at no
charge.
B.
Large items that do not fit or are not authorized to be placed in
the solid waste and recyclable collection carts are not to be placed
at the curb for disposal. Any items not authorized to be placed at
the curb for disposal may be subject to a disposal fee as determined
by the Village Board and assessed by the Village Clerk.
C.
Authorized curbside request. Under extenuating circumstances placement
of bulk/large items at the curb for disposal will be authorized. Residents
are to schedule an appointment with the Public Works Department, and
pay any applicable fees, as determined by the Village Board, prior
to collection.
A.
The Recycling Compliance Assurance Plan establishes standard guidelines
that will lead to compliance with the Village of Wrightstown's
recycling ordinance. The Director of Public Works is responsible for
enforcing the Village of Wrightstown's recycling ordinance. The
Director of Public Works and the Public Works staff shall follow the
guidelines identified in this section in response to issues associated
with recycling and solid waste. This plan is intended to meet the
requirements of § NR 544.04(9g), Wis. Adm. Code, as well
as the Village of Wrightstown's recycling ordinance.
B.
Residential recycling program compliance procedure for solid waste
found mixed with recyclables, recyclables found in solid waste, or
if a resident is not recycling within a twelve-month period:
(1)
First offense: The resident's cart will be tagged with a Public
Works Department green service tag with the appropriate box checked
and a brief description provided. Educational materials will be given
to the resident.
(2)
Second offense: The resident's cart will be tagged with a Public
Works Department green service tag, and a noncompliance letter will
be mailed to the resident.
(3)
Third and subsequent offense: The resident's cart will be tagged
with a Public Works Department green service tag, a noncompliance
letter will be mailed to the resident, and a citation will be issued
to the resident.
C.
Multifamily apartments and business recycling program compliance
procedure for not providing recycling receptacles, high levels of
contamination in dumpsters, not all required materials being recycled,
solid waste found mixed with recyclables within a twelve-month period:
(1)
First offense: The resident/operator container will be tagged with
a Public Works Department green service tag with the appropriate box
checked and a brief description provided. Educational materials will
be given to the resident, and a site visit will be scheduled if required.
(2)
Second offense: The resident/operator container will be tagged with
a Public Works Department green service tag, and a noncompliance letter
will be mailed to the resident.
(3)
Third and subsequent offense: The resident/operator container will
be tagged with a Public Works Department green service tag, a noncompliance
letter will be mailed to the resident, and a citation will be issued
to the resident/operator.
A.
Disposal at the Direction of the Public Works Director. All solid
waste, whether collected by the Village pursuant to this chapter or
collected privately, shall be disposed of as directed by the Public
Works Director or as otherwise provided by law. Solid waste shall
not be buried on any premises within the Village, and no person shall
burn solid waste outdoors at any time within the Village limits.
B.
Solid waste on public streets. It shall be unlawful for any patron
or person to deposit, throw, place, or leave any solid waste in, on
or upon any street, court, lane, alley, business, public enclosure,
vacant lot, house, yard, body of water, or any other place except
those places provided in this chapter for collection purposes. No
person shall remove any solid waste from private premises without
the consent of the occupant, owner, or lessee of the premises, and
no person shall remove any solid waste which has been set out for
collection unless authorized to do so.
C.
Disruption of collectible solid waste placed for collection unlawful.
Except upon the direction of the Public Works Director, no person
shall upset or open any cart, or upset or remove the cover of any
cart, placed in the manner provided for by this chapter for solid
waste collection, or otherwise remove the contents of any such receptacle,
in, on or upon any street, alley, or other public place.
D.
Prohibitions on disposable recyclable materials separated for recycling.
No person may dispose of in a solid waste disposal facility or burn
in a solid waste treatment facility any collectible recyclables which
have been separated for recycling.
E.
Right to reject materials. The hauler has the right to reject or
leave at the premises any recyclable material that is not prepared
according to specifications in this chapter or educational material
provided to service recipients. Materials may also be left if not
separated from solid waste, placed in the cart provided or are not
designated recyclable materials for collection. The hauler has the
right to refuse to pick up any solid waste if it contains recyclable
materials. In such cases, the hauler shall provide written notice
to the generator of the materials about the reasons for rejecting
the material. The hauler shall provide a weekly report to the Village
of incidents where solid waste/recyclables were not picked up. The
report is to include the date, address, and why it was rejected.
A.
Disposal of animal offal and other offensive wastes. Animal offal
and other offensive waste, including dead animals, loose droppings
from pets, manure, and night soil, may not be placed for collection
by the municipal collection service. It is the responsibility of the
owner of such animals to dispose of the waste in a sanitary manner.
B.
Dead animals. The owner and/or custodian of dead dogs, cats, and
other animals shall contact their veterinarian or the Village for
information concerning handling and disposal.
C.
Cinders and ashes. Cinders, ashes, and any smoldering embers shall
not be placed for collection.
D.
Disposal of infectious material. The removal of apparel, bedding,
infectious waste, medical waste, or other refuse from homes or places
where highly infectious or contagious diseases have prevailed shall
be performed only under the supervision and direction of the County
Health Officer. Such waste shall not be placed curbside for collection
with normal garbage or collectible recyclables.
E.
Hazardous and/or toxic waste. Placing or depositing any hazardous
or toxic waste, including, without limitation, explosive materials
such as dynamite, dynamite caps, shotgun shells, rifle cartridges,
gunpowder, gasoline, or other similar material, in any disposable
bag, garbage can, recyclable box or bundle for collection is prohibited.
F.
Disposal of sharps. Sharps shall be handled as infectious material
and shall not be placed curbside for collection with normal garbage
or collectible recyclables. Sharps shall be placed in a sealed sharps
container and taken by the owner or custodian to a registered sharps
collection station for disposal.
G.
Medication and prescription drug disposal. To prevent theft, avoid
poisoning of children and pets, and to stop pollution of our local
waterways, residents can properly dispose of their unwanted medication
and prescription drugs by taking them to the Village of Wrightstown
Police Department or the Brown County Sheriff's Department.
H.
Questions concerning disposal. When any patron is in doubt as to
proper preparation, handling, and disposal of any type of solid waste,
he/she shall contact the Public Works Director for information concerning
handling and disposal.
A.
Accumulation of waste. In the event that the owner, occupant, or
lessee of any premises shall neglect or refuse to clean up and/or
remove from the premises any solid waste as defined herein when ordered
to do so by the Health Officer, he, she or it shall be liable for
the penalty provided for violation of this Code. Should the accumulation
occur on any street, alley, or public thoroughfare, the waste may
be collected by the Public Works Director or his/her designee, and
the entire cost thereof assessed against the abutting property.
B.
Enforcement of maximum volume limits. All new commercial and/or manufacturing
units may receive municipal solid waste collection under the provisions
of this chapter if their waste volumes are below the maximum allowable
for collection as provided herein. If it is determined at any time
that the patron exceeds the maximum volume limit for four consecutive
weeks, the Public Works Director may issue a written notice providing
that municipal collection services will be terminated at the end of
60 days from the date of the notice.
C.
Failure to comply. The Public Works Director may refuse to furnish
collection service to any person, firm or corporation not complying
or refusing to comply with this chapter, the rules and regulations
made by the Village Board, or any other orders of the Public Works
Director or Health Officer for the collection or disposal of solid
wastes.
D.
Prosecution. When services for the collection of solid waste have
been withdrawn by the Public Works Director from any person, firm
or corporation for failure to comply with such rules and regulations,
resulting in the accumulation of garbage or other solid wastes on
his, her or its premises, which is offensive or a public nuisance,
that person, firm or corporation may be prosecuted under any ordinance
of the Village regulating the same.
A.
Enforcement by Department of Public Works. For the purpose of ascertaining
compliance with the provisions of this chapter in regard to recyclables,
any authorized officer, employee, or representative of the Department
of Public Works may inspect recyclable materials separated for recycling,
recycling collection sites and facilities, collection vehicles, collection
areas of multifamily dwellings, and nonresidential facilities and
properties. Any records relating to recycling activities may be kept
confidential if necessary to protect proprietary information. No person,
firm or corporation shall refuse access to any authorized officer,
employee, or authorized representative of the Department of Public
Works who requests access for purposes of inspection and who presents
appropriate credentials. No person, firm or corporation shall obstruct,
hamper, or interfere with any such inspection.
B.
Enforcement not exclusive. The issuance of a citation for a violation
of this chapter shall not preclude proceeding under any other ordinance
or law relating to the same matter. Proceeding under any other ordinance
or law relating to the same matter shall not preclude the issuance
of a citation under this chapter. Each twenty-four-hour period of
violation, disobedience, omission, neglect, or refusal to obey this
chapter or any order made in accordance herewith, shall be deemed
a separate offense.
