The slope of cut or fill surfaces shall be no steeper than two horizontal to one vertical or shall be no steeper than is safe for the soil and intended use, whichever is more restrictive. A bench not less than three feet wide and with a maximum slope of ten percent shall be provided adjacent to all structures at the top of slopes steeper than three to one. The need for slopes steeper than allowed above shall be avoided by the installation for approved retaining walls or approved equivalent stabilization procedures. Cut slopes to be revegetated shall be no steeper than three horizontal to one vertical. Any requests for exception shall be accompanied by engineering data which indicates that a steeper slope can be constructed in accordance with sound engineering practices, and includes details of treatment to prevent surface erosion and provide adequate structural stability.
The ground surface shall be prepared to receive fill by removing vegetation, noncomplying fill, topsoil, and other unsuitable materials. The ground shall be scarified to provide a bond with the new fill. Where slopes are steeper than five to one, and the height is greater than five feet, the slope shall be benched into sound bedrock or other competent material as determined by the civil or soils engineer. The bench under the toe of a fill on slopes steeper than five to one shall be at least ten feet wide. The area beyond the toe of fill shall be sloped for sheet overflow or a paved drain shall be provided. Where fill is to be placed over a cut, the bench under the toe of fill shall be at least ten feet wide, but the cut must be made before placing fill and approved by the soils engineer or engineering geologist as a suitable foundation for fill. Unsuitable soil is soil which, in the opinion of the City engineer, the civil engineer, the soils engineer, or the engineering geologist, is not competent to support other soil or fill, to support structures, or to satisfactorily perform the other functions for which the soil is intended.
A. 
Detrimental amounts of organic material shall not be permitted in fills. Except as permitted by the City engineer, no rock or similar irreducible material with a maximum dimension greater than twelve inches shall be buried or placed in fills.
B. 
Exception. The City engineer may permit placement of larger rock when the soils/civil engineer requesting such placement properly devises a method of placement, continuously inspects its placement, and approves the fill stability. The following conditions shall also apply:
(1) 
Potential rock disposal areas shall be delineated on the grading plan;
(2) 
Rock sizes greater than twelve inches in maximum dimension shall be ten feet or more below grade measured vertically;
(3) 
Rocks shall be placed so as to assure filling of all voids;
(4) 
All fills shall be compacted to a minimum of ninety percent of maximum density as determined by ASTM D-698-70 and ASHTO T99. Field density shall be determined in accordance with ASTM D-698-70 or the most recent update thereof, or equivalent as approved by the City engineer;
(5) 
The slope of fill surfaces shall be no steeper than is safe for the intended use. Fill slopes shall be no steeper than three horizontal to one vertical.
All retaining walls shall be designed in accordance with the Uniform Building Code and with good engineering practices. Walls higher than four feet shall be designed by a licensed engineer and plans submitted to the City for approval before construction. Any wood used in retaining walls shall be pressure treated in accordance with the Uniform Building Code, stamped or certified by an approved testing agency at the factory. Where the drainage flow is over the top of retaining walls, adequate protection shall be provided to prevent erosion of the soil on both sides of the wall.
All fills which support foundations and slabs on grade, including but not limited to floors, patios, porches, driveways, sidewalks, and fills for utility trenches shall be compacted to a minimum of ninety-five percent of maximum density as determined in accordance with ASTM D-698 or its approved equivalent. It is not the intent of this Part 6 to control compaction of backfill around foundation, but rather to make it the responsibility of the builder to correct substantial subsidence which occurs within one year of the date of the issuance of the final certificate of occupancy or City acceptance. When substantial subsidence occurs within this year, it shall be the responsibility of the owner of the property to notify the builder and to temporarily prevent any further damage in the subsided area. The builder shall correct the subsidence within thirty days of written notice by the owner.
A. 
General. Fine grading shall be constructed per good engineering standards and in accordance with the approved final drainage plan.
B. 
Slope away from the building. The slope away from the building shall have a minimum grade of 2.5 percent for the first ten feet or property line, whichever occurs first, then two percent until the slope reaches the drainage channel around the building or a drainage channel which carries drainage away from the building. If other lots are draining through the lot in question, then the slope in the first ten feet shall be increased to five percent. In no condition shall the bottom of the drainage channel at its highest point be less than six inches below the grade at the foundation of any adjacent structure.
C. 
Drainage channel around the unit. The drainage channel around the unit shall have a minimum slope of two percent unless otherwise recommended by a civil engineer and approved. Where it is intended that a drainage channel be constructed straddling the property line, both halves of the drainage channel must be constructed at the time the first building is completed. Where one side of the drainage channel is considerably steeper than the other the velocity effect of the water draining off the steep side shall be taken into account so as to prevent carrying the water over the other side. Drainage channels having sharp change in direction shall be constructed with adequate turn radius and depth to prevent overflow. Obstruction of drainage channels, such as fences, diversion works and walls shall not be allowed within the drainage channel unless adequate provisions have been made to allow passage of drainage.

C. 
Drainage channel around units. The drainage channel around units shall be constructed in such a fashion as to carry the one-hundred-year developed flow through the project without inundating any units. Drainage channels shall be piped under walks and through curb heads so as not to carry drainage collected in drainage channels over top of sidewalks and/or over top of curbs. Sidewalks shall not be constructed in the bottom of the drainage channel unless so specified in the approved final drainage plan. Where sidewalks and drainage channels are parallel the depth of flow in the drainage channel for the design storm shall not exceed the top of the sidewalk.
A. 
General. Fine grading shall be constructed per good engineering standards in accordance with the approved final drainage plan required by the City storm water runoff control ordinance.
B. 
Slopes away from the building. The slopes away from the building shall be per the recommendation of the soils or civil engineer and per good engineering judgment.
Rough and/or fine grading within major drainage ways or subdivisions shall be per an approved set of construction plans and per the approved grading plan. This grading work shall also be per the approved final drainage plan required by the City storm water runoff control ordinance.
A. 
No person shall make a change in land use, ground slope, or drainage channel which is not in accordance with the grading plan, per this Part 6, or included in the construction/land development permit.
B. 
Each violation of these regulations shall be a misdemeanor. Each violation for each day it shall continue shall constitute a separate offense, and each violation shall be punishable by either a fine of not more than seven hundred fifty dollars and/or by imprisonment for a period not exceeding six months.
C. 
Upon knowledge of a violation, the City may require the City attorney to commence action to correct the violation, charge the offender for costs incurred in correcting the violation, and otherwise punish the offender as provided by law.
These regulations shall be and are hereby declared to be in full force and effect upon the date of passage.
