There is hereby created and established pursuant to the provisions of the Act of May 1, 1933, P.L. 103, Section 599.1, as amended,[1] the office of Township Manager for the Township of Hellam, York County, Pennsylvania.

The Township Manager shall be appointed for an indefinite term by the vote of a majority of all of the members of the Board of Supervisors. The Township Manager shall serve at the pleasure of the Board of Supervisors and may be removed at any time by a majority vote of all of its members. At least 30 days before such removal is to become effective, the Board of Supervisors shall furnish the Manager with a written statement setting forth its intention to remove him, or in lieu thereof, it may remove him immediately upon tendering to him the pay due him up to and including 30 days after the effective date of such removal.
The Township Manager shall be chosen solely on the basis of his executive and administrative abilities, with special reference to the duties of his office as provided herein. The Manager need not be a resident of the Township.
Before entering upon his duties, the Township Manager shall give a bond to the Township with a bonding company as surety, to be approved by the Board of Supervisors, in such amount as may be determined by the Board, conditioned upon the faithful performance of his duties. The premium for said Bond shall be paid by the Township.
The salary of the Township Manager shall be fixed by resolution of the Board of Supervisors from time to time, and may be changed at the discretion of the Board of Supervisors.

As used throughout this chapter, all reference to words with the male gender such as "he", "him" and "his" shall refer to the individual holding the position of Manager, regardless of the gender of the individual.
A. 
General summary.
(1) 
Under direction from the Board of Supervisors, the Manager shall manage and direct the operations of the Township to ensure effective delivery of programs and services; facilitate and direct planning for use of land and capital resources which are responsive to the health, safety and general welfare needs of the community; recommend policy and procedures to ensure compliance with laws, regulations and Township objectives.
(2) 
The Manager shall develop and implement administrative and operating procedures to meet Township needs and carry out approved policies, administer the day-to-day operations of the Township government, delegating responsibility and authority for performance of assigned functions to Township staff, direct and supervise the work of all other Township employees, manage operations of Township offices; supervise staff in performance of work duties and responsibilities; delegate responsibility and authority for performance of assigned functions to Township staff; provide feedback and direction concerning program objectives; communicate policy; establish work standards to provide overall consistency in Township operation; update job descriptions; approve leave; resolve workplace problems; administer pay adjustments and discipline, hiring, suspension and discharge of employees in accordance with applicable laws; direct the provision of Township services such as road maintenance, utilities, recreation facilities, and land-use controls.
(3) 
The Manager shall serve as primary liaison to the Board of Supervisors and as liaison between the Board of Supervisors and all Township authorities, commissions and committees providing advice and information; prepare plans and programs to take necessary action to carry out Board decisions; determine priorities of projects to meet objectives approved by the Board of Supervisors and program expenditures based on cash flow; develop and administer Township policies, procedures and programs; prepare or direct the preparation of studies, reports and related information for decision-making purposes; work with the Board of Supervisors to provide for development of short- and long-range goals for the Township; recommend plans to the Board of Supervisors which impact fiscal policy, roadway development, public health and safety, growth and development of the Township, and personnel planning at the Township; consider structure of operations, level of funding, staffing, community goals and risks; engage in public relations activities; resolve questions and complaints from Township citizens or directs to appropriate staff person; develops plans to communicate issues to the public; assists citizens by informing them of Township rules and laws; explain procedures; hear complaints and resolve them or refer them to the appropriate official or board; administers functions in accordance with Second Class Township Code.
B. 
Specific duties and responsibilities.
(1) 
The Manager shall be the chief administrative officer of the Township, and he shall be responsible to the Board of Supervisors as a whole for the proper and efficient administration of the affairs of the Township. The powers and duties of administration of all Township business shall be vested in the Manager unless expressly imposed or conferred by statute upon other Township officers.
(2) 
Powers and duties of the Township Manager shall include the following:
(a) 
He shall supervise and be responsible for the activities of all municipal departments unless otherwise stipulated by the Board of Supervisors.
(b) 
He shall hire and, when necessary for the good of the service, shall suspend or discharge any employee under his supervision, provided that:
[1] 
Prior approval of the Board of Supervisors shall be obtained before enlarging staff either by the creation of a new position or increasing the number of employees in the then-present categories;
[2] 
The Manager shall notify at once and in writing each of the Supervisors of any action taken by authority of this subsection; and
[3] 
The Manager shall report, at the next meeting thereafter of the Board of Supervisors, any action taken by authority of this subsection.
C. 
He shall fix wages and salaries of all personnel under his supervision, as directed by the Board of Supervisors.
D. 
He shall prepare and submit to the Board of Supervisors, before November 15th of each year, a recommended budget for the next fiscal year and an explanatory message. In preparing the proposed budget, the Manager shall consult with the head of each department, agency or board, or any qualified officer thereof, as to estimates of revenues and expenditures and such other supporting data as he requires.
E. 
He shall be responsible for the administration of the budget after its adoption by the Board of Supervisors.
F. 
He shall, in conjunction with the preparation of the yearly budget, develop long-range fiscal plans for the municipality, such plans to be presented annually to the Board of Supervisors for its review and action.
G. 
He shall hold such other municipal offices and head such municipal departments as the Board of Supervisors may from time to time direct.
H. 
He shall attend meetings of the Board of Supervisors and its committees with the right to take part in the discussions, and he shall receive notice of all special meetings of the Board of Supervisors and its committees.
I. 
He shall assist in the preparation of the agenda for each meeting of the Board of Supervisors and supply facts pertinent thereto.
J. 
He shall keep the Board of Supervisors informed as to the conduct of Township affairs; submit periodic reports on the condition of the Township finances and such other reports as the Board of Supervisors requests; and make such recommendations to the Board of Supervisors as he deems advisable or as it requests.
K. 
He shall submit to the Board of Supervisors, as soon as possible after the close of the fiscal year, a complete report of the finances and the activities of the Township for the preceding year.
L. 
He shall see that the provisions of all franchises, leases, permits and privileges granted by the Township are observed.
M. 
He shall be charged with the responsibility for enforcement of all ordinances and rules and regulations of the Township.
N. 
He may employ and direct, by and with the approval of the Board of Supervisors, experts and consultants to perform work and provide advice in connection with any of the functions of the Township.
O. 
He shall attend to the letting of contracts in due form of law, and he shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed by statute upon some other Township officer.
P. 
He shall see that all money owed the Township is promptly received and that proper proceedings are taken for the security and collection of all the Township's claims.
Q. 
He shall be the purchasing officer of the Township and he shall purchase, in accordance with the provisions of the Township Code, all supplies and equipment for the agencies, boards, departments and other offices of the Township, provided that capital expenditures shall be subject to prior approval of the Board of Supervisors. He shall keep an account of all purchases and shall, from time to time or when directed by the Board of Supervisors, make a full written report thereof. He shall also issue rules and regulations, subject to the approval of the Board of Supervisors, governing the procurement of all municipal supplies and equipment.
R. 
All complaints regarding Township services shall be referred to the office of the Manager. He, or an officer designated by him, shall investigate and dispose of such complaints, and the Manager shall report all complaints thereon to the Board of Supervisors.
S. 
He shall be responsible for the maintenance of the Township facilities and equipment.
T. 
He shall conduct research and investigation into the administrative and governmental functions of various townships and appropriate ordinances affecting the health, safety, welfare and administration of this Township. He shall establish and maintain appropriate filing systems and efficient administrative procedures for the conduct of the business of the Township.
U. 
He shall be responsible for the implementation of the Township Strategic Management Plan.
V. 
He shall prepare quarterly objective and goals reports and provide the same to the Board of Supervisors.
W. 
He shall have such other duties and responsibilities as may be assigned to him by the Board of Supervisors from time to time.
During any absence of the Township Manager, the normal operating functions of the Township shall be delegated to such other Township officials as may be designated from time to time by the Board of Supervisors, and in the absence of any such designation or delegation, by the Township Secretary.
