The short title of this chapter will be the
"Hellam Township Key Lock Box Ordinance."
The following structures shall be equipped with
a key lock box at or near the main entrance of the structures or at
such other locations as required by Hellam Township:
A. Commercial or industrial structures protected by an
automatic alarm system or automatic suppression system;
B. Multifamily residential structures that have restrictive
access to locked doors and a common corridor for access to living
units;
C. Governmental structures and nursing care facilities;
and
D. Multifamily communities in which access is restricted
by a gate.
Hellam Township shall designate the type of
key lock box system to be implemented within the Township of Hellam
and shall have the authority to require all structures subject to
this chapter to use the designated system.
The owner or operator of a structure required
to have a key lock box shall, at all times, keep a key that will allow
access to the structure in the key lock box.
Hellam Township is hereby authorized to implement
rules and regulations for the use of the key lock box system, and
those rules and regulations can amended from time to time.
The provisions of this chapter shall be enforced
by the Hellam Township Zoning Officer, Hellam Township Permit Officer,
and any other Hellam Township official appointed from time to time
by the Board of Supervisors, or by any police officer having authority
within Hellam Township.
Any person who violates or permits a violation
of this chapter shall, upon conviction in a summary proceeding brought
before a Magisterial District Judge under the Pennsylvania Rules of
Criminal Procedure, be guilty of a summary offense and shall be punishable
by a fine of not more than $1,000, plus all costs of prosecution,
including, but not limited to, attorneys' fees, and in default of
payment thereof, shall be imprisoned for a term not to exceed 90 days.
Each day or portion thereof that such violation continues or is permitted
to continue shall constitute a separate offense, and each section
of this chapter that is violated shall also constitute a separate
offense.
