This chapter is adopted to:
A. 
Prohibit the throwing or depositing of litter in public places in the City of College Park.
B. 
Regulate the distribution of advertising matter.
C. 
Control the deposit or accumulation of litter on private premises and property.
D. 
Prohibit graffiti in the City of College Park.

Prevent the defacement of private and public property in the city.

F. 
Create a process for the removal of graffiti and the recovery of public cleanup expenses.

Protect the public health, safety and welfare and prevent the creation of public nuisances.

H. 
Provide for the enforcement of the provisions contained herein and to establish penalties for violations of this chapter.

A. 
The following terms, when used in this chapter, shall have the meanings set forth below:
ADVERTISING MATTER
Any written or printed card, circular, coupon, pamphlet or folder intended for general distribution, except newspapers.
CITY
The City of College Park, Maryland.
GARBAGE
Animal or vegetable wastes, which are subject to organic decomposition, resulting from the handling, preparing, cooking and consumption of food.
GRAFFITI
Any inscription, word, figure, mark or design that is written, marked, etched, scratched, drawn or painted on any real or personal property, other than that which is intended by the owner of such property to constitute a permanent part of the design of such property and is placed upon the property with the owner's express consent.

LITTER
All rubbish, waste material, refuse, garbage, trash, debris, dead animals or other discarded materials or property of every kind and description.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
PRIVATE PREMISES
Any dwelling, house, building or other structure designed or used, either wholly or in part, for private residential purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, sidewalk, grass or strip between the sidewalk and curb, utility strip, walk, driveway, porch, step, vestibule or mailbox belonging or appurtenant to such dwelling, house, building or other structure.
PUBLIC PLACE
Any and all streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds and buildings.
REFUSE
All solid wastes, except body wastes. "Refuse" shall include but shall not be limited to garbage, rubbish, ashes, street cleanings, dead animals, abandoned vehicles and solid market and industrial wastes.
RESPONSIBLE PERSON
As used in Article III of this chapter, an owner, or entity or person acting as an agent for an owner by agreement, who has authority over the property or is responsible for the property's maintenance and management. Irrespective of any arrangement to the contrary with any other party, each owner shall always be a responsible party for purposes of Article III. There may be more than one responsible party for a particular property.

RUBBISH
Solid waste consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery and similar materials.
B. 
However, nothing contained within this definition section shall prohibit the keeping or maintaining of a compost pile.
