It is hereby declared to be the public policy of the Mayor and Council of Federalsburg to preserve, protect and improve the air resources of this municipality so as to promote health, safety and welfare, prevent injury to human health, plant and animal life and property, foster the comfort and convenience of its inhabitants and, to the greatest degree practicable, facilitate the enjoyment of this municipality.
No person shall cause, suffer or allow any emissions of gases, vapors or odors beyond the property line from which said emissions occur, and no permitted use shall be so operated as to allow the emission into the air of any gases, vapors, or odors beyond the property from which the use is operated in sufficient quantities and of such characteristics and duration as is or is likely to be injurious to the public welfare, to the health of human, plant or animal life, or to property, or which interferes with the enjoyment of life and property which shall be offensive and obnoxious to the public.
A. 
Any violation of the provisions of this chapter shall be punishable as a municipal infraction as provided in Chapter 1, Article I.
B. 
Nothing in this chapter shall be construed to abridge, limit or otherwise impair the right of any person for damages or other relief on account of injuries to person or property to maintain any action or other appropriate proceeding therefor.
