No person shall sell or solicit orders for sale of any merchandise of any description, including books or periodicals, or services, from door to door of private residences, or from store to store, or on any street, sidewalk, park, parkway or any other public place.
All persons, firms or corporations engaged in the business of hawking, huckstering, peddling, soliciting for donations, soliciting orders for or vending of goods, wares, merchandise, foodstuffs, magazines, produce or seafood of any type or description on the streets or sidewalks of Federalsburg shall be required to procure first from the Town of Federalsburg a license and shall pay for said license a daily fee of $25 or an annual charge of $100, per person, not prorated, accounting from the first day of July of each year.
A. 
This chapter shall not include the selling of any article at wholesale to dealers in such articles or the delivery of milk, eggs, bread, newspapers or other such necessary and perishable articles of food or merchandise of a type commonly delivered on a house-to-house basis at intervals of less than one week.
B. 
Any nonprofit religious, charitable, educational, civic or veterans' organization, society, association, service club, volunteer first aid or fire, etc., desiring to solicit or have solicited in its name money, donations of money or property or financial assistance of any kind or desiring to sell or distribute any item of literature or merchandise for which a fee is charged or solicited from persons other than members of such organization at any place or places within the Town of Federalsburg for a charitable, religious, patriotic or philanthropic purpose shall be exempt from the provisions of this chapter.
The Town Clerk-Treasurer or his or her designee shall issue all peddler's licenses and collect and account for the license fees. A peddler's license shall be applied for in person to the Town Clerk-Treasurer or his or her designee, and the application shall contain the following information concerning the applicant:

Name;
B. 
Address;
C. 
Name and address of employer, if not self employed;
D. 
Age;
E. 
Color of eyes;
F. 
Color of hair;
G. 
Height and weight; and
H. 
General description of the type of merchandise to be sold.
No license is transferable.
A. 
This chapter does not apply to vendors of milk or cream, bread, meat, fuels or petroleum products, or newspapers, nor to school children under the age of 18 years selling magazines, nor to bona fide salesmen selling or soliciting merchandise for resale in stores.
B. 
This chapter also does not apply to the sale of self-produced fresh fruit and vegetables by the producer, at either the producer's property or another property with written permission from the property owner, from a nonpermanent structure that is removed at the end of the growing season.

The hours of operation for peddlers, hawkers, hucksters, solicitors, and vendors shall be between the hours of 8:00 a.m. and sundown. Upon written request by the applicant, the hours of operation may be extended by the Mayor and Council, based upon good cause shown. Such appeal shall be made at a regularly scheduled Mayor and Council meeting.
Peddlers, hawkers, hucksters, solicitors and vendors must meet Caroline County health regulations before a license is issued.
Any violation of the provisions of this chapter shall be a municipal infraction punishable as provided in Chapter 1, Article I.
